Apple not finished with Samsung yet

Apple has filed a fresh patent infringement action in the United States against Samsung, alleging that the South Korean company is continuing to steal its technology despite a recent court ruling.

My prediction is that this is going to cause significant consumer backlash against Apple.
It has already started.

I have never knowingly bought an Apple product and I never will. Not because I think they have inferior products, but purely because I think they are *******s. :)

You know that moment when someone who is winning pushes it a little too far and get royally trashed?
This is that moment.
From what I read the ruling will not stand up in a court of appeals. The claims are not holding up in the rest of the wold - and the backlash is already starting - very subtly. Steve Jobs was a self absorbed a-hole according to everyone, but he was a astute businessman. This would not have gone this far if he was alive.

It was he who promised to go thermo nuclear on android. If his biography is to be believed then this is nothing compared to that promise.

^ thermonuclear on google. The Samsung suit is a manifestation of Samsungs refusal to come to the party - Apple issued a fairly standard demand to licence stuff.

Nokia sued Apple, Apple Sued Samsung, Samsung will sue whoever takes away their little crown.

Apple vs Google is still going to come fully, that this hurts google is an added bonus rather than motive.

Paul, both Samsung and Motorola offered Apple the opportunity to licence their patents and Apple refused to pay. Apple is by no means innocent. The Google+Motorola action is coming ... and then there's LTE which Apple flatly refuses to pay licencing fees for (but they have the arrogance to advertise as part of their new products). Go see on wikipedia who registers the most patents ... IBM and Samsung. Somewhere along the line Apple is going to receive a much larger bite than the one on their logo.

Actually, Apple tried to rip Samsung off with their licensing costs- $30 per smartphone and $40 per tablet sold, for technologies they did not even invent. Yet Apple still refuse to pay for the very 3G technology that allows their iPhones to operate...

I don't see how Samsung did not come to the party when Apple have been doing it for years...

Apple should note that people don't support and appreciate those who threaten to go "thermonuclear" on others. Jobs lived high up his own behind when he made such statements ... Steve FIGJAM Jobs.

Apple is paying Nokia a ton of cash on various technologies and have a licensing arrangement with dozens of other players. I have a fairly strong suspicion that they are infriging of half a dozen or so companies IP and wouldn't be surprised if Google is having some big research into the bundle they have through Motorola. When a patent is sivved up Apple will haggle and naggle over the amount it has to pay but in the end it will fall on the comercial transaction rather than bet the farm on a court case. Samsung bet somebody elses farm.

You have no argument from me that 40$ is reaching and that there is an element of ridiculousness in the suit but my point is simply that Samsung's response to a demand of licence fees was to send Apple a response of a bill when they knew full well that they'd end up on the wrong side of cross-licensing suits. Samsung did not agree to arbitration or anything else - they hoped to play on Apple's bully behaviour and reputation and the hysteria which a "threat" to Android would unleash to act with impunity - that's why Samsung wanted a jury.

More importantly most (if not all) of the IP held by Samsung are required by industry standization processes to be available on RAND terms whereas design issues are a different animal.

Quite Simply Samsung decided to hell with it lets clone Apple and make a bit of money and dilute the market while we develop the next range of products. Apple must fall behind because they fail to innovate.

The average consumer doesn't give a rats ass about the litigation. The only people getting upset are Android fanboys and computer geeks. I don't see this having any affect on Apple sales

Yeah the average user just buys what they see as the best device at the shop. All the geek-mouth-froth means nothing to them.

I think there is a bigger backlash than Apple wants and I think it is what Samsung are banking on. Samsung is hoping that the geeks of the world will zone in on Apple and let Samsung line up a pillage. Building a reality distortion field is another thing they have copied from Apple.

Its been the strategy from day 1 and is best manifested in the decision to demand a jury in California.

... in that case, not Apple ;)

If/when the "geek" community gets upset the consequences may well be more severe than some here think/expect. V for Vendetta. Yeah baby!

Your "average user" can only afford a Nokia feature phone, NOT the best device at the shop. All these fancy schmancy smart phones are out of their price bracket. The above average user that can afford a smart phone will by an Android phone, because its cheaper (and better)

Don't under estimate the mouth-frothing geeks...the average user will ask these same geeks for their opinion on which phone to buy.

“Apple will suffer and is suffering irreparable harm” because of the alleged infringement, said the maker of the iPhone and iPad.

IMHO, Apple will suffer and will suffer irreparable harm because of their thermonuclear action against everyone that is making Smartphones. Almost every article I read, i see people comment on how Apple have gone too far. I think their aggressive litigation is going to hurt their sales in the long run.

I'm sure Apple are quivering in their boots at the prospect of a vendetta by a handful of Samsung fanbois.
