Article: Shoprite fighting Massmart

Shoprite is using exclusivity clauses commonly included in shopping mall lease agreements to challenge the legality of a Walmart-owned Massmart Game store in the CapeGate centre, Business Day reported on Wednesday.

Shoprite filed an urgent interdict at the Western Cape High Court recently, against the Massmart Game directly competing against its outlet in the same mall, the paper reported.
 
I dont see the big deal. First, the prices seems basically the same. I have not noticed great price reductions @ Makro since Wallmart bought into Massmart. Second ... Game does not really compete Shoprite in the sense of goods .... Shoprite focuses more on groceries ... Game more on appliances etc etc.... unless that has changed since I was inside a Game last.
 
Game is moving into groceries. Ours is already halve of the shop floor turned into groceries in Centurion.
 
Then the same should be for Canal Walk? There's a massive Checkers and a Game in the same mall...
Same in Parow Centre. Both Game and Checkers have massive floorspace in there.

Yea, as was mentioned, Game is moving into groceries/fresh food and that's what's making Shoprite getting very scared. I'm sure that the Game store has always been there in that shopping mall, it's only now because they are selling similar items as Shoprite that they want this stopped. I suppose the most likely outcome is to stop Game from selling certain goods.

I know Game in Centurion Mall has seriously ramped up their grocery section , i was surprised to see i can now go there to buy whatever i usually bought at my local SPar.
 
Would be nice if Shoprite spend some effort into cleaning their stores, they always feel dirty.
 
Makro is always better than Game (same company, I know). But I just prefer to go to Makro. Prices are better.

I only go to Checkers for a few House Brand items, like their canned Dog Food and Diet 2 Liter Drinks.
 
Shoprite should rather train their staff at Bayside and Sandown road branches. Lazy, rude, insulent! Not a pleasure going there......................
 
shoprite need to take their rotten produce off their shelves to begin with instead of trying to compete with other stores with fresher produce. the audacity of it is that shoprite actually sell this rotten fruit and vegetables as well.
 
Don't know what it is, but all the Shoprite/Checkers and Pick'n Pays around Fourways/Northgate feel really filthy/dirty. If you don't know what I mean - walk into the Broadacres Superspar or Woolies and then hope across the street to Dainfern PnP or Shoprite/Checkers/PnP at Fourways - yuk...
 
From what was written in the article, Shoprite does seem to have a legitimate case. The lease/rental agreement in question seems to apply to that particular mall only, giving them exclusivity. So Game has to either stop selling groceries, or close shop. Obviously, it will depend on the lease agreement that Game has with the mall.

If the 2 agreements are in conflict with each other, this will turn out to be pretty interesting. If there is no clause in the agreement with Game which prevents them from selling groceries, the mall owners are going to be caught between a rock and a hard place, with both sides having an axe to grind with them.
