Article: We have settled the matter with Sars: Malema

We're not comparing political parties here though. This is Julius in his personal capacity. Logically we all know that he can't afford to pay back that money so he has to be getting it from somewhere. As a stupid example, wouldn't you want to know if he's found some way to pay back his tax using tax payers money?

I want to know who is financing Juju, and I want to know who was financing Agang and forced them to merge with the DA, and I want to know who financed Zuma when he was fired by Mbeki, or who financed the DA's R100m elections' budget for Gauteng, etc. But it's hypocritical for a rival politician to criticise Juju for not revealing his financiers when she herself is refusing to disclose hers. And it's ignorant to suggest that those who are paying Juju's tax are not doing it because he's an EFF leader. EFF is a one man party, so you can't differentiate between Juju and EFF.
 
That's a question of convenience truly speaking, especially coming from Helen Zille. Remember that all political parties refuse to disclose their funders, so we can't expect Juju to do otherwise. For instance, who financed the DA's R100m elections budget for Gauteng? Only political parties know and they will never reveal that information. SA is poorer for not knowing who finances politicians. It's a fact that Juju is being financed by someone, but all politicians are financed.

As a qualified accountant you should know better than to post drivel like this. This is a PERSONAL tax issue and has nothing to do with a political party.

That is what SARS are after of course...

They want the info, so they can tax the giver (once they breach the thresholds which they will do) and then also add to Malema's tax bill when he breaches the donations threshold.

The donors have to pay donations' tax, and that's SARS' gripe with the whole donation and rightly so. But we know that political parties receive undisclosed donations from undisclosed donors yet SARS doesn't force the parties to disclose their donors, so Juju also has a right to feel aggrieved as it's double standards.

2. SARS is investigating Juju not the EFF.

It depends on how he is receiving donations. If he opened a trust account where the public can donate then it will be difficult to disclose because he wont know.

Of course, but we don't know how donations were channeled. If they were channeled through EFF then it makes a whole lot of difference.

EFF would then be channeling money to their chairman and it would HAVE to show on their financials which SARS will have sight of...

My point exactly. If it's the EFF that settled then he can say EFF settled my debt. If its EFF then it gets very complicated because they can claim that the taxman is politically motivated to get the names of their donors.

They can claim it but it won't be true.
 
I still would like to know 2 things:

1. If the tax bill was R16 million, how much was the income taxed, and where did he get it. Did On-Point Engineering just pay over almost every sent they received for their tenders? What about the tendered products/bridges or whatever they were supposed to build?

2. Where did the income, generating 16 million in taxes go? It was not put into his "stuff", most of which was auctioned. Did not even cover the tax bill, so where's the rest gone?

If a political party were to generate an income outside of party activities or were to put funds to for-profit use outside of the scope of the exemptions applicable to political parties in statute SARS would smack the party in a heartbeat.
SARS certain does want to know what Chancery House is up to and same must provide SARS with copious amounts of information.

The DA was called in to court to provide an account of funds received by the NNP from criminals when those criminals estates went into liquidation - IIRC the entire affair caused quite a scandal in the formation of the DA (by merger) and departure of the NNP from the DA into the ANC - good ol Peter Marais.
The ANC has been called to account to SARS for Kebble money.

So no the record is that SARS are very much capable and prepared to deal with the problem of political parties being used as a tax evasion mechanism. Nothing suggests that the EFF is being asked to disclose their donors only that a proper account for the settling of the tax debt of Malema be made. There are no double standards being shown - at least not by SARS.

SARS aren't the authority to deal with the ethical issues pertaining to political party funding nor is it their responsibility to look at the considerable problems that exist with political parties as a species of voluntary association with respect to perverse incentives

If the EFF as a party were to settle Malema's tax liability then so be it but they will have to establish how doing so doesn't violate the purpose of a political party. I strongly suspect that the EFF can wrangle a situation where the party essentially owns Malema and can hold in in a perptual debt bondage to the party and doing so wouldn't require the EFF to disclose much to SARS at all - other than that the EFF is Malema's master creditor (well master) and that the interest represents his remuneration.

Julius Malema’s Economic Freedom Fighters (EFF) receives funding from ministers in Zimbabwean President Robert Mugabe’s Cabinet in order to “destabilise” South Africa.
This comes after the claim was made by Baba Jukwa, a high-ranking yet disillusioned figure in Mugabe’s Zanu-PF. Yesterday, he claimed Malema was being funded by Zimbabwean Youth Development Minister Saviour Kasukuwere, Defence Minister Emmerson Mnangagwa, commander of the Zimbabwean defence force General Constantine Chiwenga, and State Security Minister Sydney Tigere Sekerama.
This is ostensibly in revenge against President Jacob Zuma and his international relations adviser, Lindiwe Zulu, who has been heading the Southern African Development Community mediation process in Zimbabwe following the violent 2008 polls.
The claim came as Mugabe yesterday again slammed Zulu at a rally in Bulawayo.
“May South Africa stop its negative voice. I appeal to Zuma to stop this woman to stop speaking on Zimbabwe,” he told the crowd, according to the Southern Eye newspaper’s Twitter feed.
EFF spokesperson Mbuyiseni Ndlozi yesterday said Zanu-PF Youth would be invited to the party’s launch mass meeting next weekend.
But he denied that the EFF had “approached or been approached by anyone from Zimbabwe or any other country regarding funding”. He added that the EFF “reserve the right to approach anyone we see fit for help”.

Julius must have stashed away a couple of millions from his previous dealings. This boy is no fool, he knows too much to go to jail. I feel sorry for those paying too much attention to the theatrics in parliament. It's part of the script and something big is in the pot ready to be served.
