I needs some advice from people that might be a bit more legally minded than myself as I am in the midsts of a fight with Autopage.
Some background -
I Upgraded my contract in June. I gave them an offer from TelkomMobile and asked if they would match, which they agreed to. The Product was a VodacomS with a Galaxy S6, and included was 1gb of data per month for 24months (the data was the item that they matched from Telkom). They agreed to the extra data, and I proceeded with the upgrade.
I have this negotiation about the extra data recorded in email.
In July I got sms's saying I am running out of data, emailed my consultant who apologised, extra data hadn't been loaded correctly (confirmed in email)
August I see again the bundle isn't included.
Now in september, Autopage is happy to give me the bundle, but at an extra charge, they say it was never part of the upgrade, and they have no record of it. I have the record of it, but they seem to ignore that.
To me this is plain and simple misrep, but arguing with them doesn't help.
In the real business world, misrep means a contract can be cancelled, from inception, but obviously I am one man, and threats to sue or go to the press is going to be ignored. In thwory I am protected by the CPA, but Autopage also knows that the CPA is useless
I hate being bullied like this, but I am at a loss as to what to do. screaming over the phone does no good to my blood pressure and has no effect on them.
