Totally agree with you on this,I was thinking more in the instance where your car has been damaged and you now react.
Landing in a ditch as a result of a smashed windscreen at 40km vs 120km type of thing.Sure they would both be pretty bad,but one would be much worse

N3 rock throwing suspect arrested

DURBAN - A BREAKTHROUGH has been made in Durban’s spate of rock-throwing cases, with the arrest of a 26-year-old man near the Tollgate Bridge in Berea.

Police believe the suspect is linked to several other rock-throwing incidents.

His arrest followed two incidents of cars being struck by rocks on the N3 under the Tollgate Bridge yesterday and three pedestrians who witnessed the incidents apprehended the suspect before police arrived.

Laphale Mbusu, who was on his way home to Seaview, in a red VW Polo, was the first victim.

“I was driving home around 6am when the incident occurred. The rock (almost soccer-ball size) hit my windscreen. Luckily, I managed to control the vehicle. I was unharmed, but it felt like a near-death escape,” said Mbusu.

Hopefully he gets charged with attempted murder. Also massive thumbs up for the pedestrians!

SAPS spokesperson Lieutenant Nqobile Gwala said the suspect, who is currently detained at Mayville police station, has been charged with malicious damage to property and will appear in court on Monday.

Yes isn't it ****ing ridiculous..? So if I shoot at someone in a car driving by I can get away with only a "malicious damage to property" charge? Because ultimately its the same thing isn't it.....

Rock-throwing suspect enjoys 'damaging cars'

Durban - A Cato Manor man, arrested in connection with two rock-throwing incidents at the weekend, allegedly told police he “derives personal pleasure” from damaging people’s cars.

The 26-year-old man was caught after the rock-throwing incidents from Tollgate bridge over the N3 on Saturday.

According to a source, the man was identified by the victim of the second incident.

The first incident took place just after 6.30am on the N3, just after Ridge Road. An hour later, a rock was thrown on to a second vehicle.

According to police, the first driver was taken to the police station when the suspect for the second incident was arrested.

The suspect was identified as being the same person in both instances.

Police spokesperson Captain Nqobile Gwala said a case of malicious damage to property was being investigated by Mayville SAPS.

“He will appear in court soon,” she said.

You’d have to see what comes to court, it might as well be a NPA strategy.

Sometimes, the prosecutors charge on the lowest 100% proven ground that will easily allow them to keep the guy - avoiding debate and discussions from the defense.

And then requalify the charges to higher ones once you could investigate better.

For example, you have a guy who raped and punched a woman. You want to nail him for rape obviously but the rape wasn’t in public and is a bit flimsy while the punch was in public. You’ll first charge for assault, get his bail denied and then during the investigation (once you have enough elements to prove the rape), come up with the rape charge.

Alarming twist to ‘rock throwing’ on M4

A 66-year-old Ballito man is traumatised after his car was hit by an “unknown object” that was thrown across the M4, near La Mercy yesterday afternoon.

“I was driving alone from the Umdloti bridge near La Mercy, toward Ballito at around 2pm yesterday. An object, that looked like a plastic drum with wire around it, was thrown into the air from the opposite end of the road.

“It landed right in front of my car and hit the number plate and the front grill,” said Mike Knowles.

Knowles said he pulled over a few meters away, along with another motorist who saw what had happened and stopped to offer assistance.

Durban rock-throwing suspect to appear in court

DURBAN - ALLEGED rock-thrower Nkosinathi Mthalane, 26, is expected to appear in the Durban Magistrate’s Court tomorrow.

Last week the Sunday Tribune reported that a suspect had been arrested after two cars were struck by rocks on the N3 under Durban’s Tollgate bridge.

Subsequent interviews with a complainant, Laphale Raphael Mbusu, reveal that the first incident happened on the Brickhill on-ramp to the N3, not far from Tollgate bridge.

Mbusu said a man had stepped off the side of the road and smashed a large rock through the left side of his windscreen. Mbusu went to the Mayville police station to report the case.

Later in the day, Mbusu was called by police who told him a man had been apprehended by passersby who had seen him throw a rock from the bridge.

KZN mom narrowly escapes rock throwing on M4

The incident occurred at about midday on Monday on the M4.

An uMhlanga mother has warned other motorists using the M4, between the La Lucia and uMhlanga off-ramps, to be vigilant after she narrowly missed becoming a victim of a rock-throwing incident.

The Izinga Ridge resident, who wanted to remain anonymous, was travelling in a northerly direction on Monday around lunchtime when the incident occurred, North Glen News reports.

“It was on the M4 just as the two lanes converge into one. I was driving towards uMhlanga when I saw a large brown object thrown from the opposite side of the freeway. I thought initially it was a coconut because it was brown, but as it landed, both I and the driver on the opposite side swerved to avoid the object.

Patrols to curb bridge attacks

The city has deployed several scholar patrols on bridges to curb rock-throwing attacks.

The city says the deployment of several scholar patrols, on 16 bridges prone to notorious rock-throwing incidents around eThekwini, has helped reduce the number of such incidents.

However, the patrolling is currently only taking place during the day.

Deputy mayor Fawzia Peer, who chairs the security and emergency services committee, argued that since the patrollers were posted on February 18, there had not been a single rock-throwing incident reported.

“We definitely did not get any further incidents recorded lately from the bridges that are patrolled by metro police, the scholar patrols and the Expanded Public Works Programme personnel,” she said.
