BIS capped on MTN

If these clowns are going to change their existing contract benefits, then at least give the user the option to opt out. Somehow I suspect this will apply to prepaid and new BIS subscribers - I cannot see the legality in their proposed action for current contract BIS subscribers. Will wait and see with an official statement - this SMS I never did receive. So until then **** them, I will still move my moola to Cell C.

is that even legal?

The contract i signed (for the wifey) says 24 months INCL BIS FOR 24 months.....they cannot unilaterally change the rules, why sign a contract in the first place, just give me the fphone and charge me every month for it.

Contracts are there to protect BOTH parties, not to allow one big bully to rape the little guys.....:(

just checked the so's data usage : 126mb for the last month, so she will still be ok, lucky i jumped ship from BB in Jan

you can bet that little stunt won't make it into their adverts :" Oh, so you got a BB from us last year when we promised you BIS for 24 months? Well guess what, suckers !........"

edit : removed all the swear words :D

Exactly. Maybe they are allowed to change it but the faact is that they adverstised it as having unlimited browsing and internet access. Now that is not true anymore so they lured you into signing a contract. That must be illegal right?

Was only a matter of time before abusers killed BIS.

If this came from RIM, other service providers will follow suit.

BTW, lawyers don't charge R59 pm for unlimited services :p.

BB isn't that bad (for the wife) who sms the crap out of her phone. I don't like it.. but it saves me motherless amount of ZAR.

And I can't see how MTN can just change the contract like that. Then they should allow existing effected clients to cancel their contracts too. Now people are stuck with a different product..

Whatsapp, Skype, Gtalk, FBM... the list is endless.

MTN can change any contract they have, read the fine print and you will see.

The contract stipulated you get BIS for 24 moths included, you're still getting it, but they changed the T&C, which is legal from their contract side.

Somewhere on the contract there is a clause that allows them to change it if I'm not mistaken.

Why would you buy a blackberry now when most blackberry uses install whatsapp. Time to wake up and go android. Did the blackberry ever manage to get viber to make a call or is it still just messaging? I suppose I could check but who really cares.

New BlackBerry BIS, BISBES and BES Terms and Conditions

After 01 March 2013, Customers currently on BIS will continue to receive the benefits associated with BIS, until:

- in the case of Contract Customers, their contract term being up for renewal, upgrade or migration; or

- in the case of PayAsYouGo Customers, the BIS plan will automatically expire 1 (one) month after the last loaded BIS plan voucher. No further BIS plans may be loaded on the Customer’s profile after 01 March 2013. PayAsYouGo Customers with a recurring BIS plan will be notified to subscribe to the BlackBerry Absolute Service plan, Source

I know. Its cute. Won't fly in court though.

One of the core elements of a valid contract is consensus between the two parties.

Lots of companies take a chance on this...ISP favour that BS too.

Are you legally qualified to make such sweeping statements? Unfortunately for you, this argument won't last a second in court. True enough, one of the element of a contract is consensus BUT by signing the contract, you agree to the terms and conditions of the contract. Our legal system expects people to honor their agreements. Surely, you can negotiate the terms and conditions BEFORE you sign the contract but in practise the providers are not negotiable. You either sign it or you don't get the contract. Therefore, the contents of the contract will determine if MTN can end your BIS service. If no such provision is made in the contract, MTN will be in breach of contract should they unilaterally end your BIS service. As simple as that.

We use Whatsupp to talk (I'm on android). But with her friends being on BBM already.. it's cheap. I don't like crackberry, but BBM is working for her and family/friends etc.

And it's crap they can change the contract like that. Luckily wife is with Cell C.

How long before the Big Red follows suit?
Not long methinks. It was unsustainable after all......

***.. when they sold me the blackberry device they told blah blah blah unlimited blackberry internet and now what is this they are now telling me ?

Anyone whining about the cap is part of the reason it's been implemented: the guys dling a GB and over every month (and bragging about it), screwing it up for everyone else on the network.

+1.

R59 pm was for unlimited browsing not downloading. For normal use i.e. email / apps / BBM / browsing you'll safely use under 200MB per month because the data is compressed. The abusers though will go through that amount in less than a day.
