Bought car without papers

Was probably given a copy which is worthless

Everything turns on whether he actually has physical possession of the car's registration papers. The fact that the registration papers are still in the previous owner's name is irrelevant. If you have physical possession of the registration document then that is enough to change ownership.

if the new owner is a decent human being and he got screwed, then I'm sorry but the only thing you can do is strip the entire car down for spare parts. Then throw the chassis and the engine block in the dustbin. Maybe you could get some money back that way...
 
Technically the car is stolen. You need the original owner's permission. If you dont have it, then sorry you can also be held criminally liable for purchasing a stolen car.

Best would be to find out how much the original owner is owed and pay that off if you keep the car, or lay a case against the person that sold you the car, so that you recover your money.

Buying a car like this has serious red flags. I normally check that you have all the documents correct before you transfer a cent.
 
Why will they impound the vehicle? I have been stopped before and they just gave a fine that I did not pay. They can`t impound cars for expired licenses.
Car has technically been sold without the owners permission = theft.

The guy that sold you wasnt the owner.
 
License disk has a number, that can be scanned showing continous non payment and impound or worse if the original owner reports stolen. If you show no disk, they can impound because of no vehicle license and not knowing roadworthy.

But go ahead, drive like a fool and insurance as well.

Also driving a stolen car, can also land you in jail with a criminal charge.

Thats why making sure the person is the correct owner before you buy is a big yes. If theyre not, the car can be taken away and you have no claim to keep the car. It will be returned to the actual owner of the car.

Your only claim (in small claims court) would be to go after the guy that sold it to you.
 
What to do (friend who runs a panel beater works says he has done this 3 times)

Get SAPS clearance
Obtain a roadworthy certificate
Proof of payment from the last seller
Prepare an affidavit saying the papers are lost and get it stamped at the SAPS
Pay for a duplicate reg document
Apply for a change of ownership

In Cape Town, he has done this at the Plumstead municipal office succesfully

Someone slipped a few bucks under the table hey, or probably it was his tow truck driver buddy and his connection at the licensing dept that did it for him...

From my experience getting a duplicate reg document if you are not the current owner and do not have a legal document granting authorisation to apply for one from the current owner or their estate it's impossible, a copy of their ID is also required.

And for good reason to, if your method worked just about anyone with physical access to a vehicle could transfer it into their name without the owners knowledge. The scammers would have a field day exploiting the loophole.

Hi, if anyone can assist with the below situation I'd really appreciate it!

We bought a car, and the only documents we got were the vehicles registration document. The seller of car is not the original owner but we do have contact with the original owner.

The car is not stolen, but was sold multiple times without the papers, according to the original owner. The lisence disk is also behind.

The original owner does not want to give the papers because the person he sold the car too owes him money.

We would like to know how do we get the car on our name and sort out the lisence disk etc without dealing with the original owner? We have already tried simply asking for the papers but he does not want to do that until he gets his money from one of the previous buyers (who we don't know and have no contact info of)

We have messages between both the original owner and the person who sold the car to us explaining this whole situation (after the sale was made)

We are based in Port Elizabeth/ Gqeberha

Please help!

In Cape Town, at least, it's impossible to get a duplicate reg document without the actual owner going in person. Every licensing department you go to has big signs up all over the place advising of this fact. It's the one transaction that cannot be done on your behalf.
 
My question is how does the "original owner" keep his current vehicles. As far as I am aware the will not issue you a new license disk if you have a vehicle that is outstanding or with an expired license.

I may be wrong but

You are working on the assumption that he own other vehicles.
