You talking about the farmer seeing a dog - or the people in here that see no problem with a R10 000 fine for a boys life?

I don't care if it was racially motivated or not, I don't care if the farmer genuinely believed he was shooting a dog or not - that sentence is a disgrace.
 
We'll family of mine lost a child a few years ago due to a drunk taxi driver skipping a red light and hitting their car. The taxi driver received a suspended sentence and his licence was not even taken away as the magistrate did not want to take away his livelyhood. Oh the taxi driver was black child white ... so our justice system cuts both ways only differnce the media does not latch on to these stories

I have shot a few stray dogs before. Have you seen what a few stray dogs can do to a heard of sheep? Noses eaten away, ears chomped off... And then you sometimes have to kill about 4 sheep at a time. And now you gonna say " Oooo why didnt you chase them away"? Simple: when they taste sheeps blood they will just come back for more.
 
@ubberfunk, I understand that you are trying to put yourself in the farmer's shoes, how about this: put yourself in the mother of the little boy's shoes...

Yip, she should have made sure to tell him not to go creeping around in the veld.

Given the above example, I think the killing of stray dogs may be justifiable. I don't think it excuses the farmer in this particular case though. I don't think the incident was racially motivated, but I do think the farmer was VERY irresponsible.

Owning a gun is a HUGE responsibility and the type of person who, when not in immediate danger, shoots first and checks later is not fit to have a licence.

He was not under attack therefore he could not have been defending himself or his property. You don't shoot dogs that stray into your property, unless you are a sick man. You also don't fire a gun in the dark unless you are one of those trigger-happy lunatics. You don't shoot at traspassers unless you are a trigger-happy lunatic. Now that he's paid the fine he can carry on his merry way - shooting at "STRAY DOGS"

Cant find the english version. What it says is, the WORKERS showed him the stray dog, he aimed and shooted. The dog ran away, after a while he shot again and relised a child was in the bushes.

I'm terribly sorry for the family of this child, but he tried everything after the incident to SAVE this little boys's life.

He said for about the past three weeks a stray dog had chased away some of the impala on his smallholding. The dog also killed three of his blesbuck.

He said he had warned people in the vicinity about the dog.

On the day when Sello was shot dead, people on the smallholding where Sello's parents worked apparently called Nel and said the dog was there.

Nel testified he knew that children lived on the smallholding.

He added that a certain Abraham pointed out a white object as a dog to him.

Snormossel: you forgot the equally important second part of rule 4.
iv. Be certain of your target and aware of what is beyond it.

The SAP often ignore this rule, and bystanders get hit as a result. Bullet doesn't stop moving just because you missed your target.

As for this farmer... the circumstances aren't clear, but while he should be allowed to shoot trespassing predators, the idea is to make certain that it is in fact a predator first. A couple of seconds or a warning shot could have saved this kid's life. Yes, he was where he shouldn't have been. Yes, it's plausible that the kid was mistaken for an animal. The child's death is still a tragedy.

kiepie: please link the more detailed article that you're quoting. Oh, and accept that there will be kneejerk reactions.

Animals don't stand conveniently out in the open, particularly when hunting or scavenging. Also not when they're hiding from a potential threat. If the kid was bent over doing something, or perhaps trying to keep his head down because someone was shooting, then it's entirely plausible that he could have been mistaken for an animal. The poll *should* ask whether the farmer was justified in shooting at an indistinct target, rather than whether the target could have been mistaken.
 
Sorry but I am very much in the camp of him being wrong.

You don't shoot at anything you don't personally see and identify.

This guy should be in jail with that rugby player from a few years ago who murdered his daughter.

No wonder the government wants to take guns of civilians with lunatics like that running around.

I think a farmer should be allowed to shoot stray dogs.
Farmers/people should be allowed to shoot people who are threatening them or their family.
Farmers/people should be held up for murder for shooting someone by mistake. There is no place for mistakes in life and death circumstances.

The Human Rights Commission is investigating the case, with a view to setting up sentencing guidelines for murder, culpable homicide, etc. they have said that each case must and will be looked at on an individual basis, but there needs to be some sort of guideline - hopefully this will go a long way in sorting out the inconsistencies in sentencing - he mentioned four similair cases where sentencing seemed either too harsh or too lenient - I stand under correction but a women was sentenced to three months imprisonment for stealing a bar of soap - while this farmer gets off with a fine -

I personally know of a similair case, my sister was killed, stabbed numerous times, the guy who done it cofessed, crime of passion ( If I can't have you no-one will - scenario ) the sentence - six months community service
