Here's a thought for dominic & alacos, as well as Ant, does the fact that Telkodemonopolies chose to abide by the Competition Tribunal's ruling on the BCX merger, not set a precedent whereby Telkodemonopolies acknowledges the authority of the Competition Commission and Competition Tribunal, and effectively sets aside all previous statements it [Telkodemonopolies] has made contesting the authority of both the CC & CT to rule on telecommunications related competition matters?Ispa's big success was in its role in opposing Telkom buying Business Connexion, which the tribunal blocked. Brooks says it had been resolved quickly because Telkom wanted it done.
If Telkodemonopolies had still contested the authority of the CC & CT, then it would have effectively ignored the ruling and gone ahead with the BCX merger claiming that the CC & CT did not have any authority to rule on telecoms related competition matters - that however did not happen - instead Telkodemonopolies accepted the CT's authority and chose to abide by the ruling...
Bearing in mind that the merger between BCX & Telkodemonopolies was in fact a telecoms related competition matter.
