Cleaner arrested for shooting alleged robber

Johannesburg - A man has been arrested for murder after shooting dead one of three men who allegedly tried to rob him in Johannesburg, Gauteng police said.

The 40-year-old cleaner was allegedly robbed by the three men at knife point on Wednesday evening and they took his wallet, Warrant Office Xoli Mbele said.

"The cleaner then drew his licensed firearm and fired several shots [at] the suspects.

"One of the robbers, 29 years of age, was certified dead on the scene by the paramedics while his two accomplices fled the scene," said Mbele.

The cleaner was arrested and taken to the Johannesburg Central police station.

He is expected to appear in the Johannesburg Magistrate's Court on Friday.

This can go one of two ways:

1. If he shot them after he was robbed and while they were running away, then he is in trouble.

2. If he shot them while an attack was busy taking place, then there shouldn't really be a problem.

The law states that you may defend yourself from an attack, but you may not defend property. Right to life trumps right to own property.

Whatever happens, I hope the others that got away will rethink their chosen career path.

In the absence of eye witnesses he should be able to spin it anyway he wants.

Fixed! Thanks to the criminals running the ANC.
 
Worse case: He'll get Culpable homicide and a suspended sentence.

He was over come with fear and not completely in control of his actions when he shot the fleeing suspects.

Or:

Your honour, as I pulled out my gun it was chaos. 1 running at me, the others I could not see. I took a shot at the one rushing me and as the shot went off he fled as well. I think my first shot aimed at him might have missed and hit his accomplice not 100% sure. But given the fact the dead one shot in the back is not the one I aimed at I suppose I hit the accomplice in the commotion.
 
Your honour, he was running toward me while I was aiming at his legs. Your honour he must have assumed I was going for a headshot because as I pulled the trigger I saw him turning around and bending down., which is when I saw the bullet entering the left side of his temple :)
 
Normally and I say normally you don't get arrested and appear in court if it was a clear self defense case, the police might have suspicion that there was foul play at hand?

In any case thank you for removing some stains of life.

No need for stories. There are many instances where the bad guy flinches or turns briefly and he gets struck in the back.
