Contract expiry / termination queries

You should really read those T & C's that you signed when you took up the contract... It's YOUR responsibility to cancel it.

I have a lot of sympathy for your view. To make matters even worse you would find that if you sign a contract with them at a discounted monthly subscription (due to taking a cheaper phone) they automatically increase your subs at the end of the original period.

I had a similar experience and when I saw they had overcharged me (in my opinion) I complained and immediately canceled the contract. They did not try to hold me to any cancellation notice period but if I remember correctly did not refund the about R20 overcharge. :mad: It was not worth the effort to fight them.

You should I agree but when dealing with large companies I do believe it is your right to expect that the T & C's would be fair. To my mind these provisions are unethical and amount to unfair business practice.
 
This happened to my gran too the beginning of this year.. since her car got stolen, as a result she couldn't get to the head office within 2 months and she had to fork out the insane amount..

Bastids all of our South African companies is this corrupt and get away with whatever they like.. Ima get out of here

Do remember that if you are using the phone even just for incoming calls...... you are still recieving a service. whether you use it or not, does not matter. You need to pay for that service rendered.
 
if you signed for the contract just payup and give a cancellation notice,you agreed to this arrangement the moment you signed their papers...good luck if you decide to challenge them

Read the contract again. Sure the cancellation clause is spelled out in detail.

It is. And it is the same with VC, in my experience. You have to give notice.

Unfair business practice? In the SA telecoms industry? Never!

Early upgrade problem.

If you upgrade 2 months before expiry, why do they add 4 months to your new contract?
 
What car phone contract are you talking about?
I think slootvreter is to referring to your comparison between car lease agreements and mobile phone service contracts.

Did you perhaps upgrade two months early in your previous contract?
Remember it is cumulative; upgrade four months early three contracts in a row and you are stuck with your old phone for an extra year.

Well, AFAIK they only let you upgrade 3 months from the end of the contract, not dependent on when you upgraded last.

at OP, are you sure you've got it right? 28 months and not 26?
 
Contract date is 29-May-2008 and it was 2 months early. Now I'm told it expires 29-Sept-2010.
It was my first upgrade.
 
Now I get it. Thanks. Bit slow. Still don't see the diffs between a car purchase loan contract and a cellphone + service contract or even any other contract for that matter. When it's paid fully then it should expire.
After 24 months, your phone part of the 2 piece contract is fully paid. Then you should only pay for the service part. Not both.
 
The difference is quite simple.
Most people read and negotiate their car lease agreements.

I have read the LEASE aka contract agreement. Once it has been negotiated, it becomes a contract for 24 months. You are getting confused with LEASE and FIXED term contract.
Do you think that a MTN contract is a LEASE agreement. I think not. It is a CONTRACT for a fixed period.

And in that wonderful contract is an auto renewal clause. Its standard on all networks (MTN,VC,CC). The first 24mths basically locks you in with penalties for termination, then after the 24mths is over, it switches to a 30day notice.

And in some contracts there is even a clause that says you may only give notice in your 23rd month (Hello Autopage!) - this makes it hard to give notice in time.

Its not about being unfair and branding local networks as not being on par with the rest of the world. Its how business is done, and not only in South Africa. You should have read the contract before signing it and not coming onto this forum and playing the blame game and getting agro because we are telling you the truth.
