Contract expiry / termination queries

Unless things have changed recently, you still have to physically fax the service provider to cancel in writing -- and it's advisable to keep a copy of the fax transmission confirmation.

Under the current system as I understand it, an expired contract will simply continue month to month if not specifically cancelled. However under the new consumer protection laws once they are implemented, automatic rollover will no longer be permitted and ISPs will actually have to ask you, ahead of a contract's expiry, whether you want it to renew. If you do not respond it must automatically lapse. I believe this interpretation is correct, unless anyone else on this forum has a different interpretation.
 
Yes currently a cellphone contract will keep going until you actually give a cancellation notice. A physical notice is probably still best, but I think that an e0mail works(with CellC) and vodacom has a cancellation line that you can call. MTN I am not sure.
 
Discounted tariffs fall away too...

MyCall 100 was valued at R129, I was paying R89. After 24 months, it goes up to R129. (I was holding out for the 5800 at the time, was worth a month @ the higher price :))
 
Nobody here seems to know the law. Common Law that is. The CPA has not been passed yet but Common Law still exists.
I cannot cancel the contract as it is a 3rd party phone and I don't where the signee is.
Why must I pay for the phone plus airtime when the phone is paid off. R217 for R150 airtime???

I have just reversed the stop order at my bank. I will not pay for an item that is fully paid for. Stuff their smallprint.

I have a 3'rd party phone and after 28 months, I am still charged for the phone part. ie. R217.00 for R150.00 airtime.
How do I stop this? Emails to MTN go unanswered after 4 weeks. The guys at Longbeach Mall MTN look at me as if I am crazy and are of no help.
The signee of the contract that I have taken over has ducked to JHB. and I have no contact with him.
I want the airtime part but not the device.
 
Dunno marco. Ain't it still one contract? As in, you'll need to send in your cancellation request giving them 30 days notice ... and then you'll have to renew/take out a contract again.
 
If you want the airtime still i reckon you will need to have a transfer of ownership signed, either that or get a new contract considering transfer of ownership will cost R350- if you dont have a means of contacting the contract owner you are in a difficult spot right now- how would you reccomend we get hold of him?
 
If you dont cancel the contract they will charge every month until you cancel.

You want MTN to chase around some guy you cannot get hold of to get the Phone portion of the contract back from him?

And then, you expect that MTN must now accept you as the new signeee and write off the phone portion.

Maybe I am missing something but if the contract is not in your name I do not believe you have any legal liability to continue paying. If you just stop paying the original contract holder could potentially be held liable and he might have a claim against yourself depending on the agreement entered into when you took over the phone from him. You would of course have to give up the number associated with the contract. If you can I believe you should do everything in your power to contact the original contract holder and arrange for him to give notice of termination of the contract however even if you do not MTN's claim would be against him - not yourself. If MTN has recorded the transfer of the contract to yourself you should be able to give notice of cancellation.
 
I have reversed MTN's bank deduction. They have now suspended my SIM.

I have posted this thread before and it is still ongoing.
My 3'rd party contract expired some months ago and MTN is still billing me for "Cell Phone" part plus the network" part of the contract. In other words, they still charge me R217.00 for R150.00 airtime.
I sent them a complaint about this 2 months ago and to date have not received a reply.
I reversed the payment and MTN disabled my SIM. Good, I thought.
Now they have deducted 2 months subs from my account again even though I cannot use the SIM.
Eish, these people are airheads.
 
How to cancel 3'rd party contract?

Actually it is a 4'th party phone. My daughter's boyfriend signed for it and the account was in her name. She paid for it. They have since broken up and she moved to the UK, so I am now paying for it. The contract has expired months ago. MTN has not answered my query that I sent 60 days ago. They still charge me for the device PLUS network.

Good, I thought and dumped the SIM for a new one.
Lo and behold, they have now deducted 3 months airtime plus device.
I have no contact with the boyfriend. Now what? MTN at longbeach mall only shrug their shoulders and look at me as if I am a con artist. No reply to query!!!
What more can I do?
 
Can anyone confirm that if you notify MTN to cancel the contract at the end og the 24 month cycle, doing it on the 23rd month you need just to contact their 808 no. There is no written or electronic communication required to consent to the cancellation.

No, it is now 28 months. The SIM has been suspended so I can't call 808. I just received a letter today backdated to 12 Nov. stating that I have to pay within 20 days or the owner of the contract will be blacklisted.
So this poor guy is already blacklisted.
POOR SHOW from MTN. Disgusting
I now have no other option but to give my problem to ICASA. They helped me last time to my benefit.
