I bought my old lady a sewing machine for her birthday about two months ago. According to her, the machine doesn't work properly, snaps cottons etc and broke needles unnecessarily ( hey, I dunno anything about machines but she's used them for over 40 years so I'll trust her word :P ). We took it back to the refunds counter and asked to swop the machine for another one, we had it in it's box, with packaging and all the items but obviously the machine was used. First I was told that they would send it in for repairs, I told the lady that according to the CPA, we are entitled to refund/replace within the first six months regarding defective goods.

I was then told, "No, that only applies for items of less than R400 value". I then told her go ahead and I would report the matter. She then went and got a manger who organized the swop. I re-did some research on the act and I found this:

Right to Return Goods
A consumer is entitled to return unsafe or defective goods, including goods that are not of a good quality. This right is enforceable for a period of six months, calculated from the date of the delivery of the goods to the consumer. Where the goods are so returned, the consumer does so without penalty and at the supplier’s risk and expense.
If the goods are prematurely delivered to a consumer, the consumer may accept delivery or require delivery or performance at the agreed time and date. The consumer may also cancel the agreement without penalty and treat the delivered goods or services as “unsolicited goods or services.”

I skimmed the actual act as well but nowhere do I see a price limitation on returned goods. Anyone have any idea what she was on about? We got a new machine so we're happy but the hoops and arguing were damn annoying.

I would have a quiet word with Massmart's head office and say that their customer service representatives instore are attempting to deceive customers by adding clauses to the CPA which do not exists, and this could land the company in some relatively hot water if they did it to the wrong person.

Best bet is stay away from Game stores, after sales service is pathetic. when I get a newspaper the game store ads goes into the trash without even looking at them.

I think thats just a bit excessive.

Game has some damn good specials, and for alot of things, they're very competitively priced. You aren't hurting Game, you're only hurting yourself in the long run buy not even considering them to be a store to buy goods at.

They try their luck, because they know 9 out of ten will threaten to report them, but that probably only 3 out of ten will do so. This is why service in this country sucks overall. I don't mean everywhere sucks, but retailers know most people are too lazy to do anything about it.

Have bought numerous items from GAME incl. 32 LCD and so far touch wood have never had to take anything back, but you would think that something cheap like a sowing machine would be swopped out quickly to keep you coming back.

I have also found that managers of some of these places don't inform their staff correctly and are just plain bad managers or are underpaid so they don't care.

I bought a new vacuum cleaner (cost about R600) from Game in Fourways a couple of months ago and it packed up in 2 weeks, took it back and they swapped it out for a new one no problems, they actually gave me the choice in terms of repair, replace or refund, so looks like it might be a store specific issue?

Still trying to figure out why you bought a sewing machine from game intead of Elna or Bernina or other shops specialising in sewing machines.

I dont think you can report it or should.
The manager gave you the refund, he knows the act.
The teller did not (i think we over estimating their IQ).
I had the same issue with Builders, i bought a gas heater and gas cylinder (filled up) from them. The heater did not work, when i returned it, the tellers argued with me abt refund and replacement - but the manager did not, he replaced it the first time (my choice)and gave me a refund the 2nd time.
I actually think it was that the gas cyclinder was too full (but they never listen).
