Hits back? Doesn’t 'hit back' have a totally other meaning to it than what they are trying to do here? They are merely just responding to it, not hitting back. In any case, to be able to hit back, the customer would need to have faulted somewhere, I would say. This was not the case.

Are you sure about that? I got about 0% communication from DP about my previous order. In fact, I had to call DP to find out about the delivery estimates. They still don’t show anything under ETA in my order status. I have also been waiting over a month now for a response to a request I emailed them about.

The "fine" should be that the vendor must advertise a retraction in the same media at the same size / length etc that the offending ad was placed.

For the record: I do not think DP was negligent in this complaint - a simple error.
 
Oh, I have to add, I dont envy being in their position, suppliers in SA are so lax on correctly updating their pricelists, some pricelists have a description error (Intel Core 2 Quadro for example) on them that stays in there over a year and they dont make their pricelists that you can easily manipulate them so they can be in compared directly and they lock them with passwords and other stuff. Some never have stock of some items listed for months on end.

While this may be the case, it doesn’t put DP in any better light. How come www.Sybaritic.co.za does not have the same problems that DP have? They deal with about the same suppliers (and is cheaper, faster and and and), no?
 
I think Mr. Renen Watermeyer is a retard for complaining about a stupid EOL product. I would like him to see sort out 300 pricelists over a matter of 30 days. It is not DP's fault that the pathetic suppliers we have here in ZAR doesn't have stock nor want to work along to make a standard form of pricelists.

Almost all suppliers take their time removing EOL products from their pricelist, so that when you phone and order it, they go "we don't have it but how try .... one model higher up in the hierarchy" and if you demand that specific product, they just go "to bad, don't have it, cheers". I've seen a specific supplier putting up the 3000+ 64bit AMD on the pricelist for over a year, even when it was EOL & Out of stock for the whole time. They call it E&OF.

To bad. Stupid complain & a waste of time.

I`ve had that same problem at take2 a few times, didn`t complain.
Take2 can order something from their supplier and their supplier is out of stock and didn`t tell take2.

But at least they tell me.
And give my money back with no hassles.

Not a stupid complaint or a waste of time at all. Mr. Renen Watermeyer just did what he thought was appropriate. If it was not, the ASA would’ve thrown out the case. Some one needs to show DP that something is wrong their side in some other way, because they sure don’t listen when you merely just tell them that.

The 'respected' suppliers' pricelists Clearly shows that Product X is at EOF after the current stock is depleted. Why can’t DP then update their "advertisement" to show this? It will not take them years and years extra to do this. Why do they need to use 300 pricelists anyhow if that is such a problem? Get rid of the problematic suppliers then. I mean that’s what I do. If DP gives slow and undesired [read: NO] service, I just don’t use them anymore.

Mr. Watermeyer does not have to go through the 300 pricelists in 30 days, because that’s why DP pays their highly trailed staff to do it. In fact, DP could automate the process! All it takes is a few macros in excel (and time² - but DP does not seem to care about 'time' anyhow), and bobs your uncle, the thing can spew out highly detailed information about what supplier is the cheapest, who has more stock, what products is new, what products went bye-bye etc etc. They could even give us Direct access on their site to see an 'estimated' stock figure/status of e.g. Product X.

I also don't think it was a stupid complaint. Previously I ordered a printer bundle (you got the printer and an extra toner for just the price of the printer) from Hpshop.co.za (Digitalplanet runs it). It was supposedly a brand new special they had running.

My current printer's toner was nearing the end of it's lifetime so I ordered the new printer thinking it would take the 5 days as stated. It took over 3 weeks for them to fulfill the order.

They did e-mail me and asked whether I was willing to wait, which after being forced to buy new toner separately for my current printer (same model as the bundle I ordered), I was willing to do so I could at least have something to show for the whole thing.

If they were able to fulfill the order in a timely manner I wouldn't have had to buy a separate toner, since I was planning to use the bundled toner in my current printer and keep the second printer as backup in case something went wrong. Unfortunately I had some reports due, and they only got back to me after I bought the new toner.

At our company it is called the "Digital plant lottery". You order something and then wait and see if a) you actually get it and b) if it's the right thing.

The digital planet lottery is at least better than the national lottery, in that with the national lottery you still HOPE you win. After a couple of dealings with DP you lose all hope.

I think you're being a retard for judging someone else on a fair complaint,
a complaint for which an independent body exists.

Mr Watermeyer doesn't need to upload 300 pricelists every month. Mr Watermeyer is not running an online shop which makes false promises to customers, who place orders only to have their time wasted because no-one bothers to verify the pricelists they upload. Mr Watermeyer has a completely different occupation and to judge Mr Watermeyer we should
know what he does and how he does it. Besides that - obviously - that is irrelevant.

If DigitalPlanet can't handle being in the business of being an online shop, maybe they should quit. They should stop advertising on 5FM and so forth, and stop wasting peoples' valuable time with their BS. It's not Mr Watermeyer who chose DP, it's DP who shoved ads down consumers' throats. If they can't handle the heat - they should just stay out of the kitchen. They should have given the guy store credit maybe as an apology
but we know that customer care is very poor in South Africa.
Now they have negative publicity. I for one have been burned by DP before,
once with a faulty-out-of-box product and another time with their
'send credit card scans' BS. It's also sad that a company like HP is
using DigitalPlanet to run their online HPSHOP.CO.ZA.

A web site is not an advertisement but rather a shop front and if Digital Planet make use of any medium to advertise the item to get people to visit their web site while they have no stock, then they are guilty of false advertising.

They have just set a principle where I can lodge a complaint every time that I walk into a shop and find no Coke in the refrigerator – have all the logos and branding of Coke removed because there are no stock available?

advertisement (plural: advertisements)
1. A commercial solicitation designed to sell some commodity, service or similar.
Companies try to sell their products using advertisements in form of placards, television spots and print publications.

If I were to upload an electronic copy of a pamphlet you get in the post/newspaper/magasine to a website, is it suddenly not an advertisement now? A website is like a pamphlet - on steroids and available in an electronic form.

Thus the website is seen as an Advert and thus the ASA has the grounds to rule.

Lol @ your Coke Logo example. Just want to point it out to you that Having no stock is not 'wrong' in ASA's eyes. Advertising something that you never intend to provide, is wrong. If the shop was to Never get stock of Coke again and they were still Publicly showing the Logo & Price tags, only then could they get rapped over the fingers by the ASA.

The ASA is not stupid and is quite real by the way. :D
 
anyone had problems with say amazon? i have never dealt with DP ,but it looks like they do try to accommodate the customer (although they slow about it)

Amazon.co.uk: They told me it will take 4 weeks to deliver. They gave me a date of delivery at time of order. Few days before date of delivery was even a public holiday in SA too. I went to the post office on the day noted by Amazon. Amazon was spot on! Great Service. No Struggles. :D

DP Do try to "accommodate the customer". But they fail. Still waiting for a response on my email of over a month ago... :rolleyes:

I have fallen victim to adverts on digital planet, placed an order only to have it canceled. Its questionable whether www.digitalplanet.co.za actually has very many of the products on advertisement in stock or merely as a way of getting people to their site
