I think we've determined by now that the legality is dependent on city bylaw. The exceptions that was posted was for the City of Johannesburg. Have you seen any exceptions for eThekwini or Tshwane? Or are you trying to make CoJ bylaw into national law?

for that you need permission and a licensed technician. For the loser fireworks us mortals can buy from the shop for diwali nothing is required

@RiaX ... I have 3 dogs, They dont go moggy at all for fireworks (lucky me). But I can tell you for sure that when my whole neigborhood hears the same one individual (who lives on the hill in Padfield), those bangs were not any regulation firecracker.

Again, I dont mind anything in moderation, but holy cow, a lot of us shat our pants.... So IMO you have some very inconsiderates who are making Diwali unacceptable to the norm celebratory stuff.

Secondly how do you expect to have 'silent' displays ? that doesnt exist. You need to launch the display into the air and you need to launch it to a safe height. You not going to achieve that silently.

As always most rockets are very small now a days you dont get the HUGE rockets anymore. Another thing the bigger the rocket the higher up it flies so its not a very effective display.

Wow, is this debate going to take place every year about Diwali?

While you are legally allowed to buy fireworks, people will let them off. You got to learn to deal with it, and take the necessary precautions etc. If you feel someone if violating the law, disturbing the peace etc - call the cops, let them deal with it.

The law says stealing is illegal - but i still need to put burglar bars on my windows etc. I can't be ignorant an expect nobody to try break into my house. You sometimes have to do things to protect yourself etc.

I just googled it, Diwali in 2014 is on the 23 October.
For 2015 its on 11 November.

Be prepared people.
My solution:
Get your tranquilizers for your dogs. Talk to you neighbours, community leaders, Community Policing Forum, Local Police etc. Together with your community leaders etc setup a place where people can burst their fireworks and within a certain timeframe.
Should be a win win.

All the laws would be subject to similar rulings as our constitution allows for such tolerances for religious reasons.
Unless you in a secure estate, i doubt any by law would exclude fireworks completely.

How do you know they not regulation ? did you measure the sound ? see the display ? how do you know that fellow does not have a pyro license ? You cant buy illegal fireworks ... why ? because they illegal lol

unfortunately that will never work. The point of the fireworks is to guide the gods to your own home to bless you and your family for the new year to come. Going somewhere else kind of defeats the purpose.

Again who are you to say you may only practice your religion in designated areas ? this isnt nazi germany.

Nope, you are allowed to use fireworks for 5 hours in one day of the year, but that does not give you as a religious group the right to infringe on other peoples rights DURING that period.
