I pull over if I need to fiddle with my phone gps or take a call...most of the times though not always.

I assumed the OP was the owner of a sense of humour given the context and history. Alas, 404...

I thought I say something here, because we all take it lightly that we can sort of get away with using our phones and driving.

Fortunately I rarely use my cellphone in the car because firstly, its a R100 phone and secondly I generally drive cars that are faster than the average car and so I have to be extra vigilant about my surroundings.

What angers me is that he was most likely speaking to one of his friends about stupid things, and as a result I've incurred a huge cost which money will not be able to replace. I do not attach importance to money and material things in the way others do, they mean nothing to me, what frustrates me is that people have absolutely no idea of the consequences of their actions, and even if they do, they consciously make an effort to dismiss those consequences, and then to top it off as the pier de résistance, when the consequences do happen they don't want to account for it, actually this should be the pier de résistance, after they don't want to account for it, they want to put the blame on you!

If he was trying to save the earth and knocked me, I would have given him my car and all my others cars and paid for the damages... but no.

You DJ... basically just did what that guy did in this very thread. You tried to troll me, and then when you were caught out, you tried to explain it away, and then you tried to give it context insinuating that its actually my own doing.

I'm guessing you don't use your phone while driving, good one, you are one of the few responsible up righteous people who we need more of. I sincerely hope and pray this never happens to you, I can guarantee you I won't find it funny.

he said he didn't see me, I was atleast five seconds infront of him. So even if we believe that to be true and accurate then...

Where else could he be looking for so long? Even if it was his CD player, that would make it even worse I guess. Please come up with any reasonable hypothetical scenario that will come to his defense, I'm all eyes.

yes the key phrase there is "on occasion", and you just happen to consciously choose the earliest point possible, that to me doesn't seem like "on occasion" or do you do this in every thread where people disclose events where huge costs imposed on them? In which case I apologise for accussing you of trolling me and I take back what I said.

The car that was written off today with pump fuel & methanol makes well over 250kw/370nm on the wheels, with AVGAS & methanol 350kw/450nm reliably.

In a car that weighs a ton.

Driving and texting is idiotic, but it sounds like you also break some rules of the road...

What makes you think I'm trying to come to his defence? I'm simply pointing out the stupidity of your assumptions. Are you honestly saying that the only plausible deduction is that he was on his phone? If so, perhaps you took a knock in this fender bender that requires some ct scans performed...?

Also I'm not offended by what you had to say, I'm not sure where you got that idea from. I am angry yes, but not at you, I guess you will never understand why I am angry. The fact remains you were trolling, and you denied it, and you probably still think you weren't trolling, but whatever.

I don't think you are coming to his defence. I already conceded in a previous response that only using his phone is not the only response, but if I were to give him the benefit of the doubt, it would be that he was using his phone because any other explanation would be more stupid than that, unless you can think of something else, and I am really open to suggestions.

But if you strip away the actual events and look at the idea, you are basically doing exactly what he did, you trolled and then denied it and then tried to insinuate its because of my own doing that you are doing what you are doing.

No, I break them too sometimes. Probably to a far lesser degree than you do however... Like DJ said though, you are assuming this guy was on his phone. When you do something to yourself someday, the people you know will probably assume you were speeding.

I drive maximum 100km a month, how many km do you drive? I also have a dashcam in my car, to record everything I do, so yeah I will just go ahead and break as many rules as possible, sounds reasonable to me.

I am paying a lawyer for an "objective opinion". I don't think anyone here would be objective, thats why everyone's objective opinion here is free.

I don't really care about the car or the costs, I care about principle, and the principle is that this guy's stupidity has put me in a difficult position. I had to wait in the hospital for three hours and now I have to get a lawyer etc, the costs are already incurred and the guy still tries to put the blame on me.

To be frank, I wish he drove faster and killed me on the spot. Then he would have to sit with the conscience for the rest of his life and I wouldn't have to run around having to deal with the repercussions of his stupidity.

What exactly is his "defence" in rear-ending you? And in trying to "put the blame" on you?

1000's... 45000km a year, but not sure why that is relevant.

You said yourself how much faster your car is, than everybody else on the road. I'm just a little concerned by that statement.
