I'm still trying to work out how the OP got from that video clip to accusing the other driver of using his cellphone while driving...

Yeah, there was a huge flaw in that reasoning right from the start.

For the OP, a quick course in Logic:
You have to have the right combination of true premises to lead to a true conclusion. There are gaps in your premises, which led to your conclusion being false.

LOL, hilarious, you do know my car was highly modified as well, and they took the car into their assessment center.

Believe what you want, how long was I driving infront the guy, did you count the seconds?

Your argument is based on the premise that the guy bared straight down on you from the minute that you cut in front of him. Judging from your video, this is not true. He drove behind you for a few seconds and then you slammed on the brakes and then he went into you. You also posted that he didn't even attempt to brake but we could clearly hear the screeching of him slamming on his brakes.

You got owned by your own video, no wonder you now changed it to private.

I don't really care about the car or the costs, I care about principle, and the principle is that this guy's stupidity has put me in a difficult position. I had to wait in the hospital for three hours and now I have to get a lawyer etc, the costs are already incurred and the guy still tries to put the blame on me.

To be frank, I wish he drove faster and killed me on the spot. Then he would have to sit with the conscience for the rest of his life and I wouldn't have to run around having to deal with the repercussions of his stupidity.


And yet you have youtube videos (now made private of course) of you driving like a reckless nutcase.

You were, at most, 3 seconds in front of him, and then 2 seconds for him to react to you suddenly stopping. I'm not sure how fast you guys were going but it was obviously not fast enough for him to stop safely.

As for the law, once again you're going out on the premise that it is necessarily the fault of the guy behind you when, in deed, you cut in front of him and decreased not only his, but your following distance too, resulting in the situation you landed yourself into.

I'm only covered for third party insurance, comprehensive insurance is pointless on a car like this. The insurance will pay me out 20k, and take the car when I could sell the computer box for 20k.

In terms of insurance, as I stated before, if I had comprehensive insurance the insurance company would pay me book value for my car and take possession of it. I would get double the money from selling the car in parts myself.

remember that they pay me a settlement figure and I get to keep the car
I actually just sold the car, deal agreed to and the buyer left my flat now. he is picking the car up tomorrow (or later today if you want to be technical)
Including the sale of the wreck, I'm walking away with R120 000, not bad for a 25 year old uninsured vehicle I paid R65 000 for five years ago.

OK, I will admit I did not read your statements clearly. It sounded originally like you had gotten a lot more from the insurance than your original pay out amount. Then it also sounded like someone had paid you R120k

The insurance only paid you out 15 to 20k I would guess (you never state the amount) You sold the car mostly for the parts.

I apologise for making that mistake.

I will still point out that from you video: you were in the same lane as the other car for 9 seconds before you were hit.
You also slowed down very hard at the end, you can hear things sliding forward in your car.

And lastly, why take make your other videos private?

all the videos were originally private, for the purposes of showing to people who share similiar interests

I have been driving for 20 years, and for those 20 years I have only been driving fast cars. I've never made an accident and I doubt I ever will since I am done driving cars- I'm in the process of selling them all.

interesting you count 9 seconds, I counted 16, and he is supposed to keep a distance of 2.5 seconds. Remember he said he didn't see me, maybe you should try that as an experiment. Drive in a road and look somewhere other than infront of you for five seconds while driving in traffic, see how far you are going to get with that.

We only have your word that he said he didn't see you.
(oh and it's 3 second distance recommended between cars)

I did not know that have driving skills makes it unessesary to obey traffic laws. And you are not fooling anyone with the private video excuse. People have gone to jail for less reckless and dangerous driving than you recorded.

I Saturnz the man who had an Opel Monza 1995 car of the year in a better than brand new mint condition he wanted to donate to a museum so everyone in South Africa can go see it and be dumbstruck with awe.

* I got the insurance details of the guy who knocked me.

* I contacted the insurance company and lodged a claim, they asked me for six documents including my version of the events.

* They collect my car to do an assessment of the damage

* They return my car

* They offer me 10k in settlment, I reject and counter with my offer

* They ask for evidence to justify the counter offer and I provide it

* They agree and give a revised offer which I accept

* I sell the car.

Throughout that process they had an opportunity to not pay me, they could have believed what their client said and disagreed with what I said, we could have gone to court- they chose not to.

I have my money now, I think thats sort of game over.
