Mmm...we had a similar situation with him over at our forums, thus suspended him from further dealings until he proves his innocence.
He only ever approached me with one offer for a case shortly before I left to Australia, luckily (it seems) I decided to buy it here.
a Few things to note though - guys, it is not fair to get hardware, it goes faulty, and then you want new hardware, plus a refund (TheYak) - yes, I realise he has no customer service, based on experiences here and other forii, and has proven himself very dishonest with information provided -
He did give you the option (albeit after huge amount of emails and troubles you endured) to take the card yourself to Legend - which is not that strange at all - even with suppliers like Rectron, they sometimes require you to deal directly with component supplier, eg Intel or AMD or similar - I had a few cases like that.
Then, just as he threatens, you guys do the exactly the same - if you want to go to police, do it, get a casenumber, and stay on top of it.
Threads like these are more to gauge the reaction of the general public, and to stir emotions, rather than sorting issues.
Same with the case scenario - take your money, and order a case online if need be - you were refunded, and it is not ethical to expect a case now as well?
Yakman would be best off to make a formal declaration to the SAP, open a case, and hopefully have this investigated. He might get more reaction from SARS if fraud was involved by means of VAT not being declared, etc....
But - if he sold the items to you at the same value incl VAT he paid, and he can prove the fact, SARS has no case either - or, even if he marks up the item, but recovers only the vat he paid, it is legal.
Your best bet (for the guys with outstanding items/money) is the small claims court - unfortunately TheYak will end up sending his card back to Legend Supplier in SA, this is not as uncommon to do as is believed, the Small Claims Court will tell him he has this option, the other guy received his money back, so no leg there....
Guys, PC retailing is a cut-throat business, I have done it for years - and it is not always the supplier who is at fault - sometimes you have an option, but is to full of **** to excersise that
Don't see this as spam/hatemail, just a little input from my side after reading all 19 pages of this.
There are extremely reputable 1-man dealers around, Seth(Flytek) in the Cape, Paul(Artagra)/Trapnal/Syndicate etc in Jozie, deal with the likes of them to avoid bad service.
In reality, from a pure logic and legal perspective, neither TheYak or Incube has a case against Person, neither does he against them, as you have received goods promissed, or money back, and if the card failed after 3 months, you still have the option of returning it to the main distributor (Legend)
Soz if my reply seems harsh, guys, this is just my perception, you took the cheap way out, and you can't then be upset if decent service levels ain't forth coming. That is why you pay the 10-15% markup at the reputable guys, where they make sure they keep you happy - because you pay for it.
Yes, I know Person says he runs a 3000 man business - probably in his dreams - yet he cannot even afford to activate roaming on his cell when he travels to USA - shame - but, he lives in a dream, will grow up someday, and realize the error of his ways - hopefully.
Save yourself a lot of hassles, send the card to Legend, they will replace it if under warranty, no invoices/slips etc needed - they work on serial no on unit - I know, I had to send a BFG 6800 Ultra back to BFG in the USA, no questions asked, they replaced it with a newer 7800GTX OC.
Interesting thread none the less, and a good way to make people aware of your bad experiences.
