Drunk drivers slammed after two cyclists killed

I watched World Deadliest Drivers or somesuch yesterday, a white car caused a crash on a multi lane highway. The driver of that car said it was the truck that changed lanes and caused the accident. The trucks dashcam clearly shows the truck just stayed in its lane, even after braking and stopping after the crash, when the crash causing driver was told that he quickly changed his story to the correct version and admitted he had fallen asleep.

Yes, I saw a similar video as well, recently happened here in ZA?

i bet this guy also fell asleep, woke up to the thud and crash of cyclists. its why he only "saw them" when he said he did.

I fell asleep once and left the road at Leeu-Gamka on the way to Beaufort West. Luckily no cyclists or pedestrians on that stretch of the N1 :eek: :D Also, luckily no damage as I clearly was not going very fast. Still an :eek: moment.

Driver claims he didn't see cyclists before his windscreen shattered

Omesh Ramnarain claims that he didn’t see two Durban cyclists that he struck with his car in 2016.

He took the stand in the Durban Regional Court on Wednesday at the outset of his defence against two charges of culpable homicide relating to the death of Richard da Silva and Jarred Dwyer.

Ramnarain is accused of driving his car into the pair during their cycle training on the M4 freeway that February.

The businessman claimed that he had been following a car which had swerved at the last minute‚ all before his windscreen shattered.

He said he didn’t know if his windscreen shattered because a rock was thrown at it.

Durban motorist found guilty of killing 2 cyclists

Motorist Omesh Ramnarain has been found guilty of culpable homicide for the deaths of two cyclists who he crashed into - throwing their bodies and bikes into the air - on the M4 leading out of Durban in February 2016.Pending sentence next month, Durban Regional Court Magistrate Anand Maharaj extended Ramnarain's bail of R10 000, on condition that he hand over his driver's licence, which he did shortly after judgment was handed down on Friday.

Ramnarain had left a nightclub at about 05:00 and, according to witnesses, was travelling at high speed when he crashed into Jarred Dwyer and Richard da Silva, who were at the back of a group of cyclists on a recreational ride.

The State alleges that he had been drunk at the time. He claims he had only had four Hunters Golds and was not under the influence of alcohol.
While several witnesses testified that they had smelled alcohol on his breath, a blood sample was taken more than two hours after the legal time limit, and Maharaj acquitted him on the charge of driving under the influence.

Ramnarain’s version was that he had been driving at 100km/h, behind another vehicle which blocked his view, when it suddenly swerved on to an off-ramp. Moments later, he heard a thud, his windscreen shattered, and then another thud.

He was always going to be found guilty of culpable homicide, that's standard for everyone who kills someone on the road.
The big issue is the sentencing and they like to give suspended sentences for CH.

Hopefully he gets a decent sentence, he caused two more broken families with his actions.

Good - he got 10 years. First case I read of sentences running consecutively.

Durban - Omesh Ramnarain, convicted on two counts of culpable homicide for the deaths of two cyclists on the M4 in 2016, was sentenced Friday to five years in jail for each count in the Durban Magistrate's Court. The sentences will run consecutively meaning he will spend an effective ten years in jail.

So I haven't caught up ... But regarding drunk, it looks like a he says / she says? He says 4 ciders?

Don't the cops test by default in a case like this?

Process flaw on the cops... think it took longer than 2 hours to draw his blood so it wasn’t admissible in court
