E-toll prosecution process begins: report

Okay, my first e-Toll post since the previous debacle... Hey, things are so bad in this country, even Zuma & Cronies needs more money. I will not be surprised if this order came directly from no 1's office to start the process.

Firstly, yes, like I said before, they will randomly pick cases. Not every single person will be charged simultaneously. They are most likely to start off with those who owe thousands of Rands. They will be hell-bend on making examples, so targeting those with high outstanding amounts and did not pay a single cent, will offer the courts the opportunity to send them away to prison for some period of time and probably get the Asset Forfeiture unit to repossess properties, vehicles, etc.

I am surprised that only 2 prosecutors are assigned. They will probably work from a single court assigned to them alone. I at least thought they would have appointed more prosecutors from more courts, so this move, knowing the NPA, is something they have done to 'teach some lessons'.

Secondly, being faced with criminal prosecution is bad enough. The consequences of a criminal record - not even mentioning jail time, could be devastating for some. Jobs will be lost, people will no longer be able to travel to certain countries, such as the US or Australia, just to mention a few, who refuse to issue visas if you have any single criminal record.

Thirdly, I am glad that the JPSA are still offering their assistance many people will need it. However, I personally think whatever they want to use in court as a defense will be shrugged off by magistrates as 'constitutional' issues and they will refer the JSPA to higher courts and simply continue convicting the road users. I hope the JPSA can find some other way to somehow stop this process, but I doubt it.
 
Not in Gauteng but will donate to OUTA when this starts and follow closely! Hope it gets stopped in its tracks
 
People forget that the Gauteng Government review of E-Tolls is just a political ploy to ensure the ANC maintain control over the 3 Metro's in 2 years during the municipal elections. E-Tolls is the only fair way to pay for the use of the Unfreeways as any fuel levy will only benefit the rich that can afford extremely fuel efficient cars or electric cars and all the foreign lorries will not pay a thing for the roads. The current General Fuel duty is also not a road tax but a general tax that even Transnet is paying on the fuel used in the diesel locomotives.

I also really hope that the National prosecuting authority start confiscating the cars, lorries and motorcycles of people refusing to pay their e-tolls as these vehicles are objects used in committing a crime and the criminals must loose these assets like the cash in transit robbers and other robbers loose any asset they use in committing a crime. The same must happen to all the vehicles with false or no number plates as the only object of driving without a number plate or a false number plate is to commit a crime. This law exists in the UK and is totally in accordance with human rights.

If Government decides to increase Tax and we don't like that does that allow us not to pay the tax? No!

I'm sure they don't have more important things to do, like keeping its citizens safe from thiefs, murders and rapists.
Its more important to criminalize non payers of their corrupt system.

Down in Happy-land we're still waiting on E-toll....feel sorry for you guys up in Moolateng ....serving as the guinea pigs for this fiasco...really I do :(

What criteria did they use to go after those 40 persons/companies. Amount owed? Surely the law must say what is good for Paul is good for Peter and everyone should be equal.

More than 40 people would not have been paying for etolls since last year so surely its unfair to selectively only go after 40.
If these are random what background, ethnicity, political affiliation are these 40? 50% at least ANC members and 80% African?

If these 40 are the highest owing I imagine the 40 will be businesses with a fleet of vehicles that racked up big bills. If businesses have to close down because etolls this is more bad press for ANC.
 
I am guessing they will for now only prosecute people who have already signed the terms and conditions but are now not paying. Those cases will stand a much better change in court unfortunately. The reason for such a small amount of cases is because this is once again a scare tactic. If only one of those cases succeeds for Sanral then a lot of people will start paying.
