E-toll prosecution process begins: report

I am guessing they will for now only prosecute people who have already signed the terms and conditions but are now not paying. Those cases will stand a much better change in court unfortunately. The reason for such a small amount of cases is because this is once again a scare tactic. If only one of those cases succeeds for Sanral then a lot of people will start paying.
Damn glad I never agreed to the TOC or signed any documents

no judge is impartial due to the pension funds. dont know why a bigger thing hasnt been made of this.

or am i wrong?

The advocates will take on 40 test cases, and will head to court “when they feel ready,” EWN was told.
Something tells me we don't have too much to worry about.

No, the moment you drove on a tolled road and passed a gantry you entered into an agreement that you will pay the tolls. No signatures necessary. They will definitely begin by targeting those with high outstanding amounts as they will obviously be hit harder than those who only owes R100 or R500.

I think this has been discussed many times over in judicial circles and it has been accepted that they are allowed to hear these cases. Many judges have life insurance with companies, short term insurance, investments and more and this does not prevent them from hearing a case against any of these companies.

. If businesses have to close down because etolls this is more bad press for ANC.

I would agree, but after our last election and 62%+ STILL voted for ANC, I doubt ANC worries about "bad press". I think we are stuck with them for a f0000 long time. Jobs can be lost, ANC don't care, they just want their gravy from e-toll, 60% still vote(d) them in.

There is still a big difference between driving through a gantry and signing the terms and conditions.

People forget that the Gauteng Government review of E-Tolls is just a political ploy to ensure the ANC maintain control over the 3 Metro's in 2 years during the municipal elections. E-Tolls is the only fair way to pay for the use of the Unfreeways as any fuel levy will only benefit the rich that can afford extremely fuel efficient cars or electric cars and all the foreign lorries will not pay a thing for the roads. The current General Fuel duty is also not a road tax but a general tax that even Transnet is paying on the fuel used in the diesel locomotives.

I also really hope that the National prosecuting authority start confiscating the cars, lorries and motorcycles of people refusing to pay their e-tolls as these vehicles are objects used in committing a crime and the criminals must loose these assets like the cash in transit robbers and other robbers loose any asset they use in committing a crime. The same must happen to all the vehicles with false or no number plates as the only object of driving without a number plate or a false number plate is to commit a crime. This law exists in the UK and is totally in accordance with human rights.

If Government decides to increase Tax and we don't like that does that allow us not to pay the tax? No!

Yes and in The UK they have PROPER public transport. Would you put your life in the hands of a taxi driver shooting down the emergency lane! If the government had not miss spent my tax and I could see that my tax was actually being used for what it was I would pay e tolls, You do know last financial Year 30 BILLION rand was miss spent, so please because the government does not rain in the spending of Zuma and his cronies, why should I pay for something I already paid for. and in the words of your dear friend Zuma " I did not ask for e tolls (nkandla) so I should not pay".SO sorry Bring on the summons, I will not pay E Tolls

Statement just made by the ANC:

For an army will be raised. The drivers will be ripped from their decadent cars, and cast out into the cold public transport that we know and endure. Courts will be convened. Spoils will be enjoyed. Blood will be shed. The police will survive, as they learn to serve true justice. This great city... it will endure.

Because it is the law! I also do not like what they are doing but there are ways to change the Government.......so join in and start campaigning to change the Government through the legal process of elections. The only big difference is that between all of us that want to see a change in Government is that we cannot agree on who this new Government myst be......Red or Blue...

Apartheid was also the law.

Civil disobedience is another method of changing the law.

NO! E-tolls as implemented are not fair since it does not measure the actual usage. There are free sections and just the unlucky one pass under gantries, how is that fair? The fact that you have not deduced that and state that its fair, indicates that you have not thought the matter through and should do more thinking about it. Please think more about it and then comment.

Then we can go into the whole debate on if they can toll upgraded roads versus tolling new roads. I have new roads were built. No problem with tolling of new roads.
