But if they are not paying arent they braking contract? and thus you can get the police to escort them of your property?
 
Take the R5k you would spend on a lawyer and go find a 'mike bolhuis' type character who will kidnap him in a black van... take him to some farmhouse... strap him to a chair.. put his feet in a bucket of water... and hook him up to a car battery...

on a more serious note... its amazing how many of these low lives you find out there. People that will just never get around to paying you and always have exscuses. I dont care about your sob story... if you cant afford to rent a place... then downgrade your lifestyle.
 
You can legally evict somebody if they are doing something illegal such as selling drugs or running brothel. So, get a few mates together, who testify that they were offered sex for money and drugs at your house. Job done.

Also not sure why it's difficult to cut their lights; at our complex we do it all the time and payment follows soon after?
 
Isn't it possible to give them 30 days' notice saying explicitly that should they fail to pay their arrears in full, or make a reasonable (at least half) attempt at paying their debt, that they will be evicted from the premises and that you will call the police and have movers remove their property if they fail to leave within 7 days of the end of the period of notification. Sign it and have them sign it along with witnesses.

I believe the police shouldn't have any problem acting after that and if all else fails and this gets to court you at least have proof that you've tried everything.

Let me give a tip as I work in this industry. They won't be able to sue you or take it up as the law guys will lol at them. Change the locks, turn off the water and lights. When they go out pack all their stuff on the street. By law you may change the locks and do this, the law does not stop you from holding on to the new key as it belongs to you. Loop holes gotta love em.
 
why can't ppl just pay whats due :(

my tenants have racked up several fines for bad behaviour in the complex but they pay their rent on time. luckily, the issue is between them and the body corporate so it doesn't affect me as yet.
 
I really wish this thread would die already... ti angers me more and more each time I see it pop up. What a tit this dude is... futzing and 'gaaning aan' whilst simultaneously paying an agent to oversee his let property. Spectacular fail, get a hobby.

as if that was so easy. he is just telling the truth, defamation of character implies that the accusation is false, therefore your statement is wrong.
 
Slinky - if you're referring to me and this angering you, I hope you never find yourself in the same situation of someone taking
you for granted.

I offer a roof over his, his wife and 3 kids head in exchange for money. Yes - there is an agent - but as the house isn't theirs and they have 50+ on their books, they don't have an interest in getting money back. People walking over me angers me and if you want something done right, best is to do it yourself.

The agent isn't bad - I've dealt with her before and continue. But she little experience in dealing with such a snake who was lying from day 1.

If you think a hobby is going to make me simply forget about R100,000+ rent per annum (legally owed to me), you're seriously thick and one can see you've never been a similar situation.

Update on this, which also shows his values and morals : he goes to see a lawyer who advises him of squatting rights. He phones me and literally says, "I know you can't kick me out and knock my rights. Let me stay till end Aug (1 more month) rent free and I'll leave peacefully. Deal?"

He's since paid everything he owed - but I've listed him as a slow payer.

Long story short, he did leave on that date (6 months later)
