Embarrass tenants

EVeryone is battling to reach him.

The agent also wants me to relax and not interfere with her process (yet). So I'm sitting here not being able to do anything (yet) simmering ... which means when I explode, it's not going to be pretty. Her process should end soon.

Slinky - The reason I'm thinking about it, is because I'm short of what I'm owed. I've got more to lose and more at stake than the agent (though she is trying)
 
Well, you do have a contract with the agent dont you?

Tell her if she doesnt get this mess sorted out you will be suing her for all the costs you incur while she fails to act. Simple
 
I asked about subletting actually ;) They tell me that's illegal too ... (since the 1st contract is in place)

What contract? The dude isn't paying and so in breach and so there is no contract or at the very least there is a new one being drafted by his behavior.

My tenants are being kicked out, were late 10 days with payment, don't care about their sob story excuses. They want to stay till end of August, they have to be out by the 11th if they don't pay for the missed month and then pay for August on time.

My father suggested going to see their employer... apparently if they just see you at their work place suddenly theyhave money to pay with... from my father experience at least.
 
Get a friend whos a good actor.
Dress him up, make a fake warrant thingy.

Tell him to go to the house, price all the stuff inside the house...
Tell the owners if the rent doesnt get paid, they will lose the things that were valued...

He would either pay up or run away!
 
Get some of your buddies together - dress then up really poor, and dodge looking - stop round at the house - and tell the current tenants your subletting the rooms to cover your bills - drop off your buddies - leave.
 
why haven't you attached their furniture, appliances, cars, etc for the amount owing? surely this is the easiest most obvious pressure you can put on them.

It all needs to be done legally ; it needs to be done via a court and a sheriff. And that takes time. I needed to wait until yesterday before I could proceed with anything (small lciams, attachment etc)
 
I like the employer idea.

Start looking for a new tenant, advertise in news papers etc. Then simply inconvenience them by bringing people in to look at the place, these people being potential new tenants. You could always get a contractor to come with you while you inspect the place for damages.

From what I've heard, getting people kicked out can also be a long and painful process.

All in all, the best is probably to let the agent do her thing and to go see a lawyer to see what your options are.

No it takes a couple of days and it cost me 2500 in lawyers which you can recoup from the sale of the items. my letting agents did it for me. i signed on a tuesday and they had him by friday.
 
Two other options:
1.) sell the debt to a debt collector
2.) get rent insurance
 
get a couple of thugs to give them the message , "vacate or face the consquences"

I like your idea no 2. As far as idea no 1, most debt collectors are not interested in small debt, because their profit margin is too low.

Dolby, I am very similar to you in this regard. If I owe money, I will bend over backwards to make sure I pay it back and on time too. Hence, if someone owes me money, I expect them to do the same.

I find it cowardly in the extreme if people hide from or dodge their creditors.

I spoke about this on the forum before - we got judgment against someone for about R 25 000 and he has not paid a cent yet. Before we got judgement, he promised to pay and begged for leniency and ended up not paying or skipping for months. Apparently the sherriff now served a section 65 notice on him at his work. The thing is this: he works for a credit management company (ironic!) and he could very well get fired if his employer knows about this judgment which he has ignored. IMO, that would serve him right! If you owe someone, and you cannot pay, you don't just disappear! You go talk to them, make an offer to pay - even if it's R 100 a month, at least it means you have a conscience :mad::mad::mad:

With point number 2, I did enquire at Ensurent before the least was signed (as stated on the web site) but after weeks with no reply, I had to go through another agent (no insurance). I was also very sceptical of a company who would not reply.

Ensurent has since contacted me, but since I'm with the other agent - there's not *much* I can do.

Well. If you want them out, and they're defaulting on payments, it's simple. Hire a gardening firm. Get 6 or so "gardeners" and send them over to the house. Tell your tenant they're homeless and they are now "moving in".

24 hours and mr tenant is gone.
