Thank you for the contracts being sent out yesterday, but I have a few concerns, as what is stated in the contract isn't what was said in the meeting we had with Kalin in Secunda or as advertised on 123net.co.za
1: The addition of R3 600 construction fee for EVERY package if you go for the month-to-month option was never part of any discussions or prices given? This isn't even shown like that on the 123Net website, which now makes the packages more expensive than initially advertised. It was initially only for the Free Basic Internet package, and is the R3 600 then also allowed to be divided into R300 per month like the Free Basic Internet package?
2: 5.2 - "The Subscriber acknowledges that installation is subject to the prior payment of the construction fee corresponding to the Service chosen by the Subscriber."
What was said in the meeting in Secunda is that you won't need to pay anything upfront, and you will only start paying when you are connected and have a service with 123Net?
3: 17.3 - "Notwithstanding any provision of this Agreement, it is hereby agreed that in the event of a sale of the Premises or any portion thereof by the Subscriber, this Agreement will continue uninterrupted in respect of the Premises or such portion until the expiration thereof, including any renewal periods as contemplated above."
This is just a hypethetical in the case of somebody needing to sell their home unexpectedly. If you signed a 24 month contract and 6 months or a year down the line (as an example), you need to sell and move for work, or whatever reason. Could you cancel your contract with 123Net (if you are moving to an area not covered by 123Net yet), pay the contruction fee as a penalty, and then ask 123Net to remove their equipment if the new owners don't want it?
4: 18.2 - "Subject to clauses 19.2 to 19.4"
There is only a 19.2

no 19.3 or 19.4??
And 18.3 There isn't a 19.1.1 either?
Look, I understand why most of these are in the Terms and Conditions contract that was sent out. 123Net just wants to cover their own ass, but some of these points contradict what was discussed in the meeting.
