Five times your ADSL cap

besides Cybersmart's weird Terms, and cannot support a company that insists on using such an irritating radio add!!!!!! (their "broadband" deal sung to the tune of our National Anthem)
 
speaking of that ad, heard it again today, i quote "...three eighty four KILOBYTES for ...". I then take it that I could demand a 3072 kbits adsl line from them for R169.00 (think that was the price). Ai shame I dunno...no thanks.

This product is available for free trial from now till the end of the month under the following conditions
1. Only bandwidth used in nightrider times 1am-7.59am will be free (bandwidth outside these times may be throttled and will be charged)
2. I get daily email reports as to the correctness of the stats ([email protected]).
3. Any bugs that you find will be reported to me immediately
4. There is no p2p blocking or port prioritization on this service and you should get more than 90% of your line speed sustained during the nightrider period. (This service is not throttled to hell as someone suggested earlier). If you don't get close to line rate I would also like to know before we launch.


The product should launch officially on the 1st of the month. I will be interested to know how much extra per month you would be prepared to pay for this service. Possibly your feedback will influence the pricing that we have in mind. This service will only be available to customers who
a) have their adsl circuit with us or are prepared to move their adsl circuit to us
b) 384Kb and 512Kb circuits
c) are prepared to sing the words of our irritating national anthem advert ( just kidding)

Laurie, I sincerely admire our local ISP’s effort in trying to bring more creative solutions to the table, but the company you represent have to understand that whilst there are probably many more people who would gladly sign up with Cybersmart, there seems to be a great reluctance because of your very stringent Terms and Conditions. If anything, the many remarks from readers in this thread on clause 7 of your extended T&C, proves it.

Your comment as quoted above, besides stating the very obvious, seems to be the general mentality Cybersmart is portraying to the public. I often see this level of spitefulness in companies that are simply not hungry enough for more business. Maybe you’re not.

Don’t get me wrong – this is not a personal crusade against Cybersmart and it’s certainly not a personal attack directed at you, but why the inflexibility? Why the assumption that all your users have the technical competency of a house brick? I ask that, because there seems to be a great mistrust towards potential users emanating from Cybersmart with regards to the ADSL set-up procedure. I am certainly no IT expert and I don’t need to be to do this. I’m sorry, but the “if-you-don’t-like-it-stuff-you-and-go-somewhere-else” approach doesn’t work for me and I suspect it doesn’t work for many people here.

So now I will put it you: Remove clause 7 and you will have my business today. I am very happy with the two ISP I’m using at the moment, namely Web Africa and Open Web, but believe me, I will sign up out of principle to prove to you that I am in fact serious in giving you my business if you are willing to forego your inflexible and frankly hostile business model. I’ll leave it that.

I agree that the "7. If you subscribe to our ADSL service, you are required to cancel any other ADSL service you may have with any other ISP." is going too far. If it wasn't for that and that my ISP has given me more than what I have asked for, I might have considered it.
 
3. You may only use the account at one location - you may not use the same account at your home and at your office or at your friend's premises, but you may connect as many computers as you wish at your own premises.

4. You can only use one account at the same location- if we detect multiple accounts connecting from the same place, all subsequent accounts will be treated as top ups and you will be charged the top up rate.

5. You are required to use the @cybersmart.co.za email address that comes free with your ADSL account

6. If you overshoot your 3Gig Cap by manipulating the session timeout, the Gigs that you used, but did not pay for will be subtracted from your following months cap.

7. If you subscribe to our ADSL service, you are required to cancel any other ADSL service you may have with any other ISP.

8. If you make a mistake and say that you have a 192Kb service installed but you in fact have a 512Kb circuit installed, don't worry, you need not phone in and tell us, our system will detect it and your price will be adjusted to the price advertised for the correct circuit speed.

My ISP charges me for a cap. Nothing else. Whether I have a 192 line or a 4Mb line, same price. If I "manipulate my session for extra meggies", I am not penalised for it. I may also use my account wherever I wish and on top of that, I may run concurrent sessions. Cybersmart may be cheap, but they do seem to have a lot of restrictions.

Offer sounds great except you're screwing over the guys who pay you the most money. Ie. the guys on the 4mbps subscription.

I agree. For someone who has a 384 line, wants to use the cybersmart email supplied (not good to force a client to use it), never uses their ADSL at other locations and does not use it concurrently, the price is fine. Otherwise not at all. But that's my opinion.

This is another thing that erks me. I started with them last month, they charged me for the month and I went over my cap. Instead of hard-capping me they deducted the amount I used (about 400MB) from this month's total and then CHARGED me for it, so basically I paid for two months worth of bandwidth in one month. From my understanding, if I've already been charged for it last month I shouldn't be charged for it this month right?
 
I agree with you there. My ISP lets me go over until they feel I have had enough, then they cut me off (I do have an hard-capped account with free leniency). I would go for one of two choices: pay for the cap you use, or have it taken off the next month's cap. But sure as hell not both.

Yip. Cybersmart have approached the community with a reasonable offer, but their T&C is the problem. Fix that and somebody might just take them up on their offer.
 
wrt the condition stipulating that you have to use the cybersmart email address: Its never really been a big problem for me. Its just another account that i've added to my email client. I get my invoice once a month from that address, thats about it. Certainly wasn't a deal breaker for me.
 
I don't have a specific problem with it, but it's just a really unnecessary condition. I have after a year only started using my ISP's email address.

Thanks for the valuable feedback. It is not often that someone takes the time and effort to document clearly and accurately what they believe the problem to be and to further make a commitment of signing up should the problem be solved. In exchange I will commit to see whether the terms specifically point 7 are made less onerous.

We went to great lengths to try justify each "onerus" condition, but it appears few people are reading these points. Bottom line and off the top of my head a number of things that other ISPs have set as default will not work with our accounts eg
smtp.saix.net
news.saix.net (this used to work but has stopped recently)
saix dns servers
our dns servers with other ISPs accounts
saix proxies

So if you don't cancel your account with your other ISP and you don't really know what you doing, then what we found was happening was that you would phone your other ISP because their email was not workig and they would say put in smtp.saix.net and their email would work, then our email would not, then you would phone us and we would say put in our mailserver (but the guy does not bother telling us he has another mail account) so the alternate mail address stops working. He then phones the other ISP and the cycle continues. The aim of this condition is to stop this nightmare from happening, because at the end of the day the customer moves away from both ISPs and we get a bad name because our support is "useless".

So, how would you suggest point 7 is modified, specifically to avoid the problem documented above. I will take this modified version to our lawyer and see if he can accommodate it. I am happy to take anyones suggestion to our lawyer as long as it deals with the above issue.

Bottom line is we do not act on point 7. As long as you know what you are doing and don't phone in for support then you may do as you like. However, if you phone in and you have a problem with some other email account or you have the wrong dns server and we realise you have another ISP we will politely refer you to the terms and conditions and say we cannot support multiple ISPs. So it is really not a case of being "too arrogant to want your business", we really want to be certain that we can support you effectively and the support problem becomes extraordinarily difficult if the setup can be potentially different on every single support call. It is far better for us to have people complain about our terms and conditions than our support and from what I can see from the majority of these posts it seems that our only criticism is the terms and conditions.

So your input in suggesting a modified term 7 will be appreciated as will your business.
