It's regarding the FUP where they advertise products of uncapped unshaped and contradicts it with the fair use policy.

Sort of like this. Hey I will offer you my services to paint your house for 5 days. And then while im in there I will go through your closet and anything I find I can share with whomever I please. Also. If the house is too big to paint. I will supply and use less paint after I told you paint is uncapped and always available. .

How much can you use before being throttled/choked?

If it's a sufficiently high number then I don't see a problem there.

As far as I remember, the speeds they offer on fibre aren't great though, fibre connections should be 100Mbps and up.

They don't state that anywhere. Just like with axxess and their star level system. Downloaded 50gb in n month and got permanently shaped down to a throughput of 15kbps on a 4mb line

While acute congestion is occurring, subscribers will still be able to use the lawful content, services, and applications of their choice, but this fair sharing of bandwidth may result in slower download and upload speeds and slower response times from websites and Internet-based applications and services. 123NET fibre will not engage in deep packet inspection (where the content of the data packet is inspected beyond its IP, TCP, and UDP headers) or drop specific types of end-user Internet traffic except as described herein to preserve the integrity of the network and protect against negative effects of Internet threats.

123NET fibre does not prevent or impede the use of any other product or service that its subscribers choose to access over their 123NET fibre Internet service as long as the use of that product or service does not violate the service terms and conditions. 123NET fibre also does not favor or inhibit any applications or classes of applications except as described herein.

They do manage the network correct. But there's no FUP as you can see on their packages page.
 
Just had a giggle reading that. You think they are going to let you get off from downloading 1TB+ on a 1Gb/s local line speed? You must also think that money grows on trees as well.

Technically trees = money #mindblown

How much data do you think 4k IP tv uses? Or even 1080p. And yes.. openweb provides me with 1TB data.

If you have over 500 different households with the cheapest option, which is 10mb international. Congestion during peak is imminent. Hell, if only 100 people used their full 1Gb/s during the day there is no doubt there will be congestion.

Technically, this is a FUP, as they do in there make provision for managing traffic. The big thing here is, they do not detail it, and hide it under different gazes. And with the speed at which 123Net changes their policies and procedures, I would not could on them changing that as well. Already provision made for it

If it was technically a fair use policy it would have been called a fair use policy. You don't call a toenail clipper a fingernail clipper if it technically looks like a fingernail clipper.

For a long time, Mweb also didn't call their FUP that. It was the same as 123Net. Look where we are now.

oh, and you can use a toenail clipper as a fingernail clipper. Just as this policy of theirs can be used as a FUP. Just because the name does not say it, does not mean it can't be used as such.

A cat is a cat and a dog is a dog You don't call a dog a cat if the dog looks like a cat based on your cognitive and mental reasoning. I did not contradict anything or describe anything you just miserably failed to understand something extremely basic. It's not their fup they don't have a fup. They do manage the network yes but its not a fup just because you base it as one. It either is or it is not.

I have seen this "managing network" at another ISP. It resulted in peoples connections dropping to 5kbps regardless of time of day. This lasted over a week, so be wary.

The need is there. And I will not apologise. There are no pills for stupidity. I was stating fact. He was argueing semantics. That called for direct expression of thought.
