Hawks nab terrorist suspects

Thulsie twins expected to apply for bail today

The two brothers arrested on terrorism charges are expected back in the dock today.

The Thulsie twins are expected to apply for bail.
Brandon-Lee Thulsie and his brother Toni-Lee were apprehended earlier this month.
They've been accused of planning to bomb an American diplomatic mission and Jewish institutions in Johannesburg.

The 23-year-old twins have spent more than a week behind bars but according to advocacy group Cage Africa they have been treated fairly so far.
Lawyers representing them have been preparing their case ahead of today's court appearance.
The Hawks' Hangwani Mulaudzi said: "The case is ongoing and we expect our members to oppose bail."

Meanwhile, the Thulsie family insists that the twins had no intention of joining Isis but had planned to immigrate to Syria.

Mom of terror-accused twins in tears after hearing they will stay behind bars

Johannesburg - The mother of twin brothers accused of terrorism started crying in court on Tuesday when she heard they would be staying behind bars for another week.

As soon as the case was postponed in the Johannesburg Magistrate’s Court, their mother, who had been emotional throughout proceedings, started crying.

As she left the court room, two women comforted her. Two men quickly ushered her out of court, protecting her from media attention.

The case against brothers Brandon-Lee and Tony-Lee Thulsie, 23, was postponed until next Monday for their bail application.

They face three counts of contravening the Protection of Constitutional Democracy against Terrorist and Related Activities Act.

Prosecutor Chris Macadams told Magistrate Pieter du Plessis that the delay was due to the fact that the two had new lawyers.

The brothers, who sat closely together, each wore a fez. They occasionally smiled at their relatives sitting in the first row of the public gallery.

A woman, believed to be their sister, blew kisses at the brothers. They winked back.

There was extraordinarily tight security. Journalists were asked to show their identity documents before entering the court room.

National Prosecuting Authority spokesperson Phindi Louw told journalists outside the court that they would oppose bail because the twins faced serious charges.

Louw said more charges could be added, or arrests made, during the course of the police investigation into the matter.

"We don't know. We don't want to pre-empt the conclusions of the investigations."

‎The brothers were allegedly linked to terror group ISIS (Islamic State) and were allegedly planning to set off explosives at a US embassy and "Jewish institutions" in South Africa, according to their charge sheet.

‎‎They were arrested on Saturday, July 9, along with siblings Ebrahim and Fatima Patel during raids in Newclare and Florida, on the West Rand.

The Patels previously appeared in the Kagiso Magistrate’s Court on charges of possession of explosives and unlicensed ammunition.

Hawks spokesperson Brigadier Hangwani Mulaudzi earlier told News24 that the arrests followed prolonged investigations into possible terror-related activities in the Johannesburg area.‎

‎He said the four were identified after they tried to travel to Syria to join ISIS in 2015.

Bail application of terror-accused twins postponed

Johannesburg - The bail application of terror-accused twins Brandon-Lee and Tony-Lee Thulsie got off to a slow start before being postponed in the Johannesburg Magistrate's Court on Monday.

Their lawyer, Annelene van den Heever, wanted the prosecuting team to disclose documents which had led to the charge sheet being amended.

Van den Heever said she needed access to the documents in order to "determine what the charges are", as this could assist her in presenting their bail application.

Magistrate Pieter du Plessis said he did not have the powers to compel the State to hand over the documents.

"The State has no onus or obligation to disclose the documents," said Du Plessis, suggesting that the charge sheet was sufficient.

He instructed Van den Heever to rather present arguments on why the two deserved to be granted bail.

The Thulsie brothers are charged with a schedule six offence.

Sobbing mother

The last charge sheet documented that the brothers faced three counts of contravening the Protection of Constitutional Democracy against Terrorist and Related Activities Act.

The curly-haired Thulsie brothers, both wearing big glasses, sat close to each other in the dock.

Security was once again tight ahead of the proceedings. Heavily armed police officers stood in the passage outside the courtroom. The passage was cordoned off with red and white tape.

Journalists were required to register their names and produce their identity documents and press cards before being permitted into the court.

The mother of the twins sobbed as the pair were escorted back to the court's holding cells.

She cupped her hands around her mouth and used a tissue to wipe her eyes as she was consoled by relatives.

The bail application was postponed to Tuesday for Van den Heever to obtain further instructions.

Thulsie twins’ bail application postponed... again

JOHANNESBURG - The bail application brought by the Thulsie twins has been postponed once again to allow legal teams time to discuss the lawfulness of the case.

Thulsie twins accuse State of using 'trumped-up' charges against them

JOHANNESBURG - In sworn affidavits, the Thulsie twins say the State has failed to make a proper case against them, using "trumped up" charges without providing any details.

Brandon-Lee and Tony-Lee are facing terrorism charges.

They've been accused of planning to detonate explosives at an American and Jewish interests.

Their bail application was expected to be heard at the Johannesburg Magistrates Court yesterday, but their defence team has argued that they shouldn't be appearing before the court in the first place.
