We're selling our house and the buyers are not paying the transfer attorneys so the sale is being held up.
The buyers have a lease where they currently reside which expires end of March, so it is in their best interest to delay the sale so they do not have to pay bond and rates and taxes before they can take physical occupation.
We've provided everything needed from our side, and the attorneys reckon the sale could go through by the end of February if the transfer attorneys are paid now.
Our situation is quite flexible so we can vacate the the premises as soon as the deal is finalised.
As you can imagine, we feel as if they are manipulating the situation to our detriment. We did give them notice - before the end of January - that we would vacate the property at end of February or earlier if the deal went through earlier, but that attorneys expected that to be very near the end of February. So they could have given notice at that stage and hence did not have to wait until end of March.
Is there anything we can do to enforce timely completion of this step from their side?
Your advise and insights appreciated.

We purchased a house last year and in the offer to purchase there was a clause that if any party is delaying the process they are liable to pay a fine 3% of the price per month. We used Pam Golding and it was the standard otp they use. Maybe yours too?

Thanks for reply. We do have a Mora clause too, and if needs must we'll have to trigger that, but I doubt we'll get anything without going to court.

Make an appointment with the attorney Instead of posting on here.

Not abiding by the conditions of an OTP if finance was approved have consequences. Something you should not worry about.

Attorneys mean additional expenses, not necessarily reclaimable.
In any event, I got estate agents to negotiate a deadline for delivery and a commitment to supporting Mora process thereafter.
Thanks for input. Matter resolved for the moment.

Not additional expenses to you, it would be for them, as they are the ones delaying.

I agree that is the likelyhood, but until court rules and awards costs, it is an assumption.

Bro, this is something that happens everyday, something that these type of attorneys specialise in. Its not like you going to go to the supreme court or anything, they have methods to resolve internally by applying the required pressure. And as mentioned, you wont have to pay for this.
