How much do you pay for your flat levy?

an owner at our complex owes like R150k or something

The levies was paid up lately but interest and other stuff hasnt been paid

whay can be done ?

apparently she can win the case of not paying the interest

the building is in a bad state cause of bad payers. What can we do

From what I understand, you can charge interest on outstanding levies and legally you should be able to claim this back. I'm uncertain about interest on outstanding interest but I do know that if you go to court you will not be able claim back any 'admin' fees or anything like that. Unfortunately you will probably need to get lawyers involved to reclaim the money owed - unless you have some success via CSOS but I've never heard any success stories from that.

Honestly, I would advise letting this rest. If the levies are 100% up-to-date then be happy with that. Trying to claim back the interest is going to cost you more in headaches and legal fees.

What we've done in our complex to avoid late payment is implement an 'admin fee' and interest on interest. We've also made these rules the top item in our monthly newsletter. As I mentioned earlier I'm not 100% sure on the legalities of this but the threat seems to have worked. We also try make payment arrangements as soon as the first levy is missed. If the homeowner refuses to communicate then we start the legal process immediately. This will limit the outstanding amounts to a more reasonable ~R50k by the time the legal processes are completed and the sheriff comes knocking.

problem is we never going to get back the interest and other fees

Throw lawyers at them. We had a unit owing about 150K and we managed to auction off the unit to pay the debt. In our case though the unit was abandoned by the owners after a messy divorce and 3 sets of tracers failed to find the owners.

I think the new owner who bought at the auction became liable for the debt or something but it was essentially sorted out once we finally got the sheriff to attach the property.
 
Get a judgement and tell them either pay or have the sheriff attach the unit and sell it.

the owner is using the property and everytime an excuse is made up when it comes to paying

Too much! R1200 which is probably going to increase to R1400 with the new water tarriffs in Cape Town.

Levy includes:
- water
- building insurance
- garden services (the flat has a small garden)
- general upkeep of the complex (communial garden etc)
 
A friend is an attorney specialising in body corporates.

They regularly attach homes for outstanding levies and the interest. She said that body corporate interest isn't regulated like credit so it is quite high. Usually they represent the body corporate and they negotiate a settlement with the home owner which sometimes involves waiving some of the interest. But a lot of the time the outstanding amounts are so high that the property has to be attached.
 
Levi is the single reason I will never ever buy property in an estate / complex. It reduces your investment potential.

My GF pays R8000 for her bond and R2200 for levi (excl electricity and water). Paying more than 25% of your bond cost on levi is insane, and guess what? It only goes up every year.

so, your gf is paying this dude, Levi R2200 a month? and you are ok with this?

We have also a few bad apples in our complex / estate. One guy owes almost R400 000

We went the legal way (time isnt something on our side as it is endless processes).
 
WOW...the worst offender in our complex is one month behind. :p

We can blame a few things, but we changed now lately to a new managing agent and got REAL legal help in.

Previously we used Stylus .... That is more bark than bite !
 
I thought the R1400 I was paying was high, which it was in comparison to some of the other units around. A friend had a 3 bedroom and it was only R980
