Insurances are the biggest legal scams there is. They always look at claims from a point of not paying and the whole point of getting an insurance is for them to pay. So if you have a chance, lie, steal from them because they rip us off.

Thanks everyone, at least now I have a better idea of what the situation is.
I have a feeling that the repairs may be less than the excess if I find the right repair shop, the damage was not massive. I was told the excess would be R4200.
Another possible problem I face though is that there was another car involved, and the accident was my fault, kinda, I have photo's of the stop sign which is half obscured by an overgrown tree and the road markings which are badly faded. That is why I crashed, I didn't see the stop sign in time due to it being obscured. If this goes to court I will blame the municipality for not maintaining the road markings.
That's probably why they're sceptical of paying until incidents have been investigated. Thanks for cocking it up for everyone else.Insurances are the biggest legal scams there is. Never admit any wrongdoing, insurances will not pay. Never even under oath admit that you were wrong.
My Santam insurance doesn't care who drives my car as long as they have a license and are not drunk.
you basically also need the insurances permission to drive the car for extended periods - if you don't have that,i.e. you're not listed as a regular driver on her policy, then you could have problems.

IF the car was insured and someone that isnt a designated driver crashes it then they have to pay out regardless, all they can do is add an extra amount to the excess.
If you are a designated driver then it makes no difference as to how long you have had the car. Why would they even ask you that in the first place?
Insurance companies are always trying to get out of stuff like that, you just have to fight them.
....all they can do is add an extra amount to the excess....
Same for me at M&F. It is usually the cheap mass market insurance companies like Outsurance, Budget and Auto&General that have BS like "designated drivers". They use this as a possible loop hole to escape paying out in case of an accident. That should teach people not to mess around with crap insurance companies.
That is exactly what they have done. They did call me again this morning asking who drove the car the most so they seem to be trying something here? Will update this thread soon as I get more news.
<removed before the next forum war> Read these rulings: http://www.osti.co.za/index.php?page=regular-driver If she is listed as the regular driver, and you are the regular driver, they do not have to pay.
And then they'll have to screw over more honest people (Like say Lino) to cover the losses made due to the lying SoBs. Great. So if you have a chance, lie, steal from them because they rip us off.

Insurance companies look for any excuse not to pay a claim.
