iBurst Accounts Suspended Without Warning

I think if you buy the extra gig, you can download as much as you like...today. But if you exceed that gig, tomorrow you'll be suspended again.

Just don't remember reading about any of this in their package specs.
 
Can we file a law suite against them? I think we should be able to! They do not say anything about suspending accounts etc in their contracts ...
 
they have cash and goverment connections, unless you have the same the only way would be to do a class action suit, then in like 4 years we'll get told by a judge we were right, they were wrong
 
They are USELESS! I waste their time with cap/uncap, meanwhile some of us are getting no bloody connection at all. I just recently mailed all my friends etc. not to get iBurst. Guys let make war to make peace.

I say lets take em down. They had enough time to come right!!!!!
 
From the Signup Contract (Copy and paste):

5. Suspension
5.1 Service Provider may at any time, without notice to the subscriber and in any manner whatsoever, suspend the subscriber's access to the MDN Services in the event that:
5.1.1 any modification, maintenance or remedial work is required to be undertaken pertaining in any manner whatsoever, to the MDN Services or the Network. Service Provider will endeavour to inform the subscriber timeously, in the event of planned maintenance;
5.1.2 the subscriber fails to perform any of his or her obligations, or breaches any terms of the agreement (in which event Service Provider may also suspend the subscriber's use of the terminal equipment).

OK, I have been searching their site, and come up empty handed on our ("the subscriber's") obligation. And from reading the contract, the only obligation I can deduce is making payment.

This "excessive usage" is complete and utter BS! :mad:
We're paying for a service, and they are obliged to provide.

They really have no right to suspend fully paid-up accounts.

Three routes:

Class action - takes too long.
Small claims - claim back your pro-rata monthly sub - also a long process, but would be very annoying for WBS.
Media - Also IMO the best route - you could get much quicker results.
 
I agree, media battle will be on its way if I don't have everything working by tonight!

I guess it won't hurt them much if few people cancel their contracts, so I think we should hurt them some other way!

I have iBurst from less than 2 weeks, for the first 8 days nothing worked except the web browsing, then I had reasonable connection for about 4 days, and now I have suspended account. I am not sure how much I downloaded, but I don't thinnk it is more than 4-5 GB. And I pay for this bu11sh1t f8ck1n fortune by all international standards!!!!

maybe the assh0les at WBS must go back to the banana plants to keep the crop going, as they obviously have forgotten where they are coming from.

Media Battle

Surely in this day and age of competition W.B.S need positive feed back from existing clients to grow their user base, so obviosly one would imagine that W.B.S would not want negative/adverse reports about them.
Having said that, surely WBS would have thought this through before they disconnected the so called abusers from the network, knowing that Negative PR
would result from their actions.

Perhaps the bigger picture is that the loss of the Power USERS would be a positive thing and would show the rest of the users who fall into the nicely designed model that WBS won't let the baddies stuff up their network (sic)
and that that move will be conceived by the potential market out there as a VERY POSITIVE MOVE (snigger)

My own experience is that I purchased extra bandwidth last week but beacause the counter thingy didnt work (after reconnecting twice to be sure) I found that I wasnt uncapped again, went to check usage and now it was hugely differrent and my 1GB that i bought just got swallowed up.

I share the moods of Slimothy,s posts and feel that the obviouse double speak of WBS regarding "no limit" and "buy and extra gig" etc to be utter bad practise on WBS side.
IMHO policies should not just be made overnight with no regard to customers needs.

Further , the posts that report the network to be so fast since the abusers were kicked is junk, bfore the launch evryone was flatlining there UTD and evryone had fast speeds----- me thinks WBS NEEDED A WHIPPING BOY

Iburst Arbitrarily (and illegally) Suspending Users?

Came to a local internet cafe to post this.

Discovered I was disconnected some time last night or early this morning. Cant login.

I call at 8, Portia says 'there's some sort of problem, and the technicians estimate a fix by 9 - 9.30am

I call at 9.30. Smitty tells me that there's around 100 people with a similar problem, he says that I've reached my cap - and the 'system' has through some glitch, instead of throttling me onto the 64k line, has disconnected me.
He tells me that if I purchase extra bandwidth, this problem should go away.
But - he hastily adds - there is a problem, which they're looking at.

I call at 10, Sheila without comment, puts me through to Dylan - who tells me that IBurst is suspending some users, who are downloading huge amounts of data, and they are the ones responsible for the slow network.
I ask if I'm one of them?
He ducks the question. Tells me that I've downloaded 7 gigs sofar this month.
I say simply that its not my problem, if IBursts software fails to put me onto the 64k line I also point out that I have a contract with IBurst, which states that they auto-switch me to a throttled speed once I've reached my cap.
He ducks it again.
Takes my number, says he'll have to speak with Shaun who's on his way in.

I phone Shaun. he's on his way in, says he doesnt know whats going on,
and he's trying to get hold of Management to find out.

I raise all of the above issues with him. He has no answers.
I mention Dylan's mention of the fact that I've downloaded around 7gigs this calender month, according to the online b/w counter - and this (on the 20th of the month) is hardly 'abuse' in any way. Shaun agrees.

I also raise the legal issues - namely that I've spent nearly R3000 on a modem that can only be used with IBurst, and if they're deciding to arbitrarily suspend and cut off users who've paid them for their modems, they're going to need to reimburse the customers.

So whatever bandwidth costs are being dealt with - versus paying out up to 100 suspended customers, for their modems, and/or facing a serious court action with attendant bad publicity and media coverage - which will undoubtedly kill IBurst in a very short space of time..

(Furthermore, if IBurst think they can attract and induce customers to pay R3000 each for a modem, then - due to a failure of software on their side - arbitrarily suspend the customers AND not reimburse them for the modems, this constitutes criminal fraud.)

Shaun says to call back within two hours - says he's had to field upwards of 70 calls sofar, from others in the same situation.

So now I'm waiting

Its interesting that the official story went from 'theres a problem which'll be fixed' to 'the cap software errored out and disconnected people by accident'(but you can buy extra bandwidth to avoid this problem) to ' Iburst is suspending users who have abused the network - and who are responsible for the slow speeds - but please, its better that you speak with Shaun'

I wonder now if IBurst Management is about to cut its own throat, in a very public way.
Naturally, I hope not.

But if IBurst think they can suspend 70 -100 or more customers, and not fully reimburse them for their required outlay for the IBurst modem - forget any simple groaning and moaning on this forum - there's about to be some combined legal action.

As with Sentech before them, the INSTANT there's a legal action against IBurst, which makes it into the Media, that is IBursts adspend and PR flushed down the toilet, near permanently.

If IBurst think its going to be 'cheaper' to just suspend users, rather than have an adequate and working 'cap software' on their network - they're in for an incredibly unpleasant and very public surprise..

Let's see what the remainder of this day brings..

I think that the brainless as5ho1es that own WBS are not smart enough to figure out long term implications of their actions.
 
people, if you want to hurt WBS, I might have something for you. WBS is sitting in the SABC building right? Okay. I got an e-mail from someone saying that WBS got the license under very dogey circumstances from ICASA. SABC buidling + E-mail i got + CEO + very little heared about until they suddenly got the license = wierd stuff.

I dont want to accuse anyone, but it's worth following up. I am doing it. ICASA to blame? I wish, cause that will indirectly show that Telkom is paying the guys off too.

Remember all this is from an unreliable source, but lets investigate shall we!

Fact: The network is considerably faster today than over the past two weeks.

Fiction: Bandwidth "abusers" were slowing it down.

Fact: WBS were sabotaging their own network to preserve bandwidth because the bandwidth management software they installed doesn't work.

Fact: WBS could have given everyone full speed this month, but they were clearly unwilling to foot the bill.
