iBurst - warning for excessive usage

Okayyyy...this is quite a debate

here's my 2c

Ask yourself the following questions.

So if your connection is cut and they did not warn you beforehand, then the above statement is false.

So if I downloaded 3Gb or 300Gb (due to YOUR bw monitor that's not set up correctly), it's not really my problem. If you cut my connection because you feel that I've downloaded too much, well that's a BIG PROBLEM, since your clause stated that your a 24/7 connection.

Any ISP should know (like Sentech) that some of the users will take full advantage of the 64K throttle and therefor they should have implemented a rule from day 1 stating that if you go over, let's say 30Gb, then you will be hardcapped. That seems fair, but cutting someone off without even a warning is unprofessional and IMO pathetic.

To hell with me downloading 30Gb anyway since I can't even fully use my current 2.5Gb since they recently started to limit (or actually block) P2P/Torrents. Now since i'm not even THROTTLED, I can't see any reason whatsoever that I'm not allowed to P2P/Torrent.

Most people download 20Gb+ are using DC++ anyway, connecting between iburst users (local).

Nowhere does it state anywhere in my contract about limiting or even worse blocking P2P or hardcapping people for excessive usage. What kind of business does someone run if they let you sign a contract but break the rules/terms contained within.

Bottom line, I signed for a 24/7 Internet connection with no hardcap and no P2P limit or blocking, and that's frankly what I expect for the R600 I pay every month.

You cannot change a contract or agreement unilaterally, then try and penalize the other party based on that change.

Contractually:
iBurst promotes a package as service X. Service X states you may download Y amount of data, thereafter you are throttled to a 64k slow speed thereafter.

This was, no is, a selling line. This package was developed by iBurst. As such they should have made provision for such bandwidth usage.

They cannot suddenly decide they cut you off without warning. On the "old" T&C they cannot even revert to Item 4 if anybody takes them to task for damages, since this is deliberate.

I have sympathy for other users who are affected by others always downloading. Yes, I can know why the are upset. But at the end of the day, this is the fault of the service provider. They developed a specific package, in fact charge more for the "pro" option (which used to be the normal option), then whine if somebody relies on it. The same risk of this happening existed then as now. The group objecting to uncapped 64k limit had the same option to not sign up, if we have to point fingers. I am not, but this is reality.

I used to be on iBurst but "fired" them as my service provider due to service delivery issues, never relying on the 64k but buying top ups.

It does not help that group A and B goes hammer and tongs here. Regardless of whether you download 100GB on 64k rate, this was okay initially and agreed upon. Ig the low bandwidth user object because of bandwidth issues, good on you, but do not focus on the 40GB'ers. Both groups should be heading to ICASA for non performance as per agreement.

This is exactly the same as when the top up prices changed. iBurst conveniently forgets they sell a feature a benefit, then cries foul and wants to make money out of the end users for their own mistakes. They most likely hoped to sell top-ups to the users that continue to use the 64k.

The only way iBurst can legally rectify this split their infrastructure into the pre-agreement user segment, and post agreement segment shown by Abe. Alternatively turn the taps back on and do it the legal way with notices etc. We also need to recognize that iBurst changed the T&C without notifying a soul - see Abe's link and what it was a year ago. This is a very dirty trick by iBurst.

I know iBurst's legal team will be reading this. Read and understand!
(although that is a bit like trying to address the Zimbabwean Minister of Harbours)

You do all make very good points but I feel your arguments are circular.

I don't see iBurst doing anything wrong. The throttled speed is great for people who went over their cap but it was never meant for bandwidth hogs to pay for a 1Gig package and then line up your downloads for the entire month.

You are all happy to point fingers and complain about iBurst being immoral but you are just as bad. If you know you need the bandwidth then you should be paying for it. Or at least pay for the bigger package. You have taken the cheapest option and are now complaining.

I see iBurst laughing at you all leaving now :D

You say the arguments are circular, but it is clear that you haven't bothered reading them.

64k is little more than dial-up.

The 64k throttle costs pennies compared to the cost of attracting and retaining customers.

Any company laughing as their customers leave is a company that before long will have no customers at all.

Accounts shocking. Customer care disgraceful. Additional bandwdith prices astronomic. Network overcrowded. Service degraded.

Iburst may be doing a lot of things, but laughing isn't one them.

The best part about this all is you all get on this moral farking high ground and how 'illegal' ibursts actions are yet we all know what is being downloaded across the hubs. And please dont tell me you downloading linux iso's ect cuz if 30Gb is linux distros then you deserve to be hardcapped.

so really take the splinter out your own eye before you attempt the same on someone else.
 
Well my account is working again. Seems iBurst came to their senses. Now I hope they publish their fair usage policy and I intend to use every single GB it allows because I am paying for it.

This thread will show potential customers the moral fibre of iBurst.

Cell C currently offers its subscribers 120 free minutes every weekend. Now I Mr. Abuser actually uses all 120 free minutes the weekend. Does that make me an abuser? Like I said previously:

Not from where I am sitting. What I download has got nothing to do with you. I want the service I signed up and paid for.

I did manage to download over 20-30Gb on Feb..
I don't use linux, so not distros BUT not warez either

My downloads consited of the following

1.) Youtube videos (for my website)
2.) Updates for all my software (windows,adobe,ejay,virus,etc.)
3.) Downloaded all the latest drivers for my machine (Check the sizes of the things) the bluetooth driver alone for my HP6130b is 98Mb
4.) Atleast 8-10Gb went on FREE samples for my ejay program, and another downloading the FREE songs the other artists made.
5.) And when i'm bored I play online games like C&C Tiberium Wars

etc, my point just being, that there are other things to download except warez and distros, like I did as mentioned above. I would have originally got myself a Telkom connection with extra local cap etc etc, but I can't install a line where I stay (long story) so I went for iBurst due to their 64K uncapped offer. I also VPN to work and use my connection for LogMeIn.

I see nothing wrong with this - it is simply normal usage of a broadband connection.

Try this with a dippy-dawg 33k/48k/56k dial-up... you'll get nowhere.

i couldnt care less if people download warez, music, games and movies. I know i do. I just dont complain when i get a phone call from iburst moaning about me using too much BW.
