ICASA: Telecoms providers must interconnect

Telkom will never approve this so I fear we'll end up with something as wishy-washy as the adsl regs.
 
Agreed. Its time ICASA puts down their foot - especially now that there are going to be upwards of 8 players in this space (maybe they won't have a choice, Telkom should no longer be able to dictate the industry).
 
Keep in mind that the ADSL draft also addressed a lot of issues. The final was rather, what shall we call it? Flawed? Useless? Set up by telscum for telscum?

I would love to see if history repeats itself with these regulations.

Good draft regulations -> telscum -> Bad draft regulations -> ICASA -> Useless regulations
 
Great, another nice draft that can be sent out to a law firm that is not remotely involved in the industry to 'correct'.

Telkom will find a loop hole in it like every other time.

You really have to admire telkoms ability to twist things into a positive for themselves (while taking it out on the customers)

If only the consequences of their actions were not so dire for the country I suppose one could admire their tenacity.....

..unless said 'person' has a larger legal team than ICASA, whereby the regulator will back down and do anything they say in order to avoid costly legal battles...

this is a redraft - the original draft was released round september last year and oral hearings were held....from my initial reading icasa has taken many of the submissions made by industry into account and i quite like this document (especially when read with the list of essential facilities published recently)

these are not the adsl regs - excuse me for saying this but these are far far far more important and far-reaching...they also do not only affect telkom but the entire industry

as a result ICASA have put their A team onto this one - it is headed by Cllr Tracy Cohen who is frighteningly competent and more than willing to tell telkom where to get off (as i have seen her do on more than one occasion)

:) there will be at least 15-20 players in the network space (we have eight currently)....if i get my way and the high court action about to be launched is successful the number could be far far higher

[but please do bear in mind that telkom will continue to hold the aces for some time given its sheer size and expertise]

Would that be technical or legal expertise?

Keep in mind they fired 10,000 of their technical expertise a few years ago ;)

ICASA also lays down some interconnection agreement principles which include Quality of Service, Service Level Agreements, Standardization, Confidentiality, Non-discrimination and transparency.

Other issues which are addressed in the set of draft regulations includes the required terms and conditions for interconnection agreements, the negotiation and conclusion of such agreements, the filing of interconnect agreements, the implementation and contravention of agreements, dispute resolution, significant market power and penalties.

According to the regulations any ‘person’ who contravenes the regulations can be fined up to 10% of its annual turnover over the period of the offence.

What will the impact of all this be on [searchforum]JINX[/searchforum] & [searchforum]CINX[/searchforum], and will SAIX be forced to interconnect with JINX & CINX or the other way around?

Well first of all CINX is no longer in operation and secondly the bigger ISP (inc. SAIX) prefer to interconnect directly with each other bypassing exchanges points like JINX. Not sure how it will pan out from an IP perspective?

On the the voice side, my experience has been that our 2 larger mobile networks have be the most obstructive/demanding/unaccomodating wrt. interconnect. Telkom by comparison have been relatively 'nice'.

ICASA has shown quite a lot of interest in JINX - busy finalising how it will interact with the regs

& agreed re the mobiles - unbelievably arrogant and obstructive
