"You may not attempt to interfere with service to any user, host, or network ("denial of service attacks"). This includes, but is not limited to "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host."
1. There is no attempt to interfere with the service to any user, host or network.
2. There is no deliberate attempt to overload a service or to crash a host.
3. Testing performance does not amount to "flooding" which is anyway undefined.
Please come up with real legal reasons why you think it is illegal. My guess is you haven't even read what is on that site so you don't respond to any of it.
