Hey guy's long time no see?

Things I've already done

1. Reported fault at tshwane
2. Asked for a special disconnection form
3. Have sent special disconnection form for 4 times
4. Being told by tshwane adviser - "...we don't care about you"
5. Approached the police to open a case with reference number
6. Illegal squatter in house - that does not want to move out
7. Waiting for court appearance date
8. Reported the delinquent to the ITC for credit fraud
8A. Also wrote a complaint via Hellopeter

9. Running out of options?

10. Any additional advice would be highly appreciated

11. Rentee is a lawyer and takes full advantage of the system to undermine the landlord, City of tshwane, and South Africa law.
thus the city of tshwane is also undermining the rights of the landlord

See my rant below

For anyone who does business with Zachariah at Tshwane I own a property at xx estate and have requested for the power and utilities bill to be disconnected on 29 April 2019 at 16h00 whilst it was in arrears by an illegal occupier. I have been told by City of Tshwane Municipality in Centurion that they will not bother to disconnect. Even thou it clearly states on the form that the owner of the property has the right to disconnect the power by request and put it back on through the OWNER! Which means there is a conflict of interest. City of Tshwane Municipality of Centurion agrees to the following by not replying to this message that they will take full responsibility for their negligent actions. I would like to ask all the community members of Centurion who has similar issue to lay a formal charge and complaint everywhere we can until someone at tshwane actually does the work with competence and not incompetence Anyone's matter in this regard will be greatly appreciated in numbers! Lets all stand together and let our voices be heard!!!

Rant over (for now)

Any advice to resolve this issue would be highly appreciated

Wot?

You can't disconnect a tenant's power/water for not paying rent or illegal occupation. Barking up completely the wrong tree...

Initiate eviction proceedings, good luck

Well, the agreement was until fully paid - and it is lawfull the rentee doesn't pay or abide by his obligations

No its not, read the rental housing act. For a breach of rental contract you will need to obtain an eviction order to get them out. There is no other legal way, you cannot cut power/water or make the property uninhabitable, as they're a lawyer they know this and will take you to the cleaners if you try.

I'm assuming you are the owner and renting out? If so you are in the meantime legally obligated to pay any municipal account in your name.

IIs it fair, no, it's bullshit. But that's the situation you're in.

Fact is a lawyer means he's going to be an *******. He'll probably even block your "renovation" process through the courts. That is, he'll spend money frustrating you but still refuse to pay you.

I had a tenant who wanted to give me issues and lawyered up. Got sheriff to go load up his stuff while he was away. He paid up in double time. My tenant was a doctor not a lawyer though. But it could work for you too

He can't, but CoT can (OP just must not pay CoT and hopefully squatter doesn't). The tenant illegally connected it again. The tenant is stealing from the rest of CoT residents if he is not paying for the power.

What does your ward councillor say BillytheBrave?

What does the rental housing act say about renting it out to other people*?

*unpleasant ones

Supersinbird is 100% correct I have dealt with COT over this issue for the last two weeks.. All my obligations are on paper and done to the letter, whilst the *oer is having his own way...

Will also add to the list

He said i should report to senior officials - but they are even more useless,

You could try embarrass the city on social media. Say how they don't care about illegal connections. Or use one of the radio shows on 702. Some of them will call the city

Great will do! The advice here is gold!

OK you're not understanding here... If the owner of a property stops municipal services to a tenant it is NOT illegal for the tenant to request reconnection.

In fact it is illegal to request the disconnect in the first place.

Get an eviction order, it is not the municipalities job to sort out your non paying tenant.

So when someone does fraud on your bank account - in other words you are saying its not your banks responsibility
to sort out your fraud case? if not who then?

Also please explain owners consent vs tenants consent
