Illegal re-connection without owners consent

OK you're not understanding here... If the owner of a property stops municipal services to a tenant it is NOT illegal for the tenant to request reconnection.

In fact it is illegal to request the disconnect in the first place.

Get an eviction order, it is not the municipalities job to sort out your non paying tenant.

Also note that the tenant is seen by the court as an illegal squatter

It's amazing how easily a fire can break out in a house now days. Would be sad if the house burned down with them in it....

please note that tenant is seen as an illegal squatter by the court
Hope that you have this proof as there is this portion from that special disconnection form that might require it as proof if and when needed:
However the owner should accept and acknowledge to bear all cost such as legal cost, action charges, etc. that might arise from the actions taken. The latter might inter-alia involves legal actions that might emerge from the said suspension of municipal services.

So when someone does fraud on your bank account - in other words you are saying its not your banks responsibility
to sort out your fraud case? if not who then?
Your analogy is flawed. Its every citizen's constitutional right to essential services. You cannot remove that right.

Only a court of law can.

This is my first post here, I've been a long time lurker.

Please follow the advise and lawyer up. I have just gone through this process and am seriously having second thoughts on rental properties.

In total, it took 7 months to have the illegal tenant removed from my property and a crap load of money later.

Please feel free to PM me, should you like to discuss further?

Best way is to follow the legal route and keep your side clean.

Would be so sad if the electrical meter box was driven over or caught alight. That would be so bad... now power... shame

I presume the whole 7 months from beginning to end?

7 months from deciding to lawyer up, until the sheriff went to remove him from the property. Needless to say, by that time he caused a substantial amount of damage to the property as well.

Do you know what was the motif for him to keep staying there? Hence the forceful removal?

I would rather not divulge all the details. My advise would really be to get legal help in this regard. If it is in Pretoria area, I can give you details of the lawfirm which assisted me. They would be better suited in giving you all the details in what need to happen and how to go about it.

Fact is a lawyer means he's going to be an *******. He'll probably even block your "renovation" process through the courts. That is, he'll spend money frustrating you but still refuse to pay you.

I had a tenant who wanted to give me issues and lawyered up. Got sheriff to go load up his stuff while he was away. He paid up in double time. My tenant was a doctor not a lawyer though. But it could work for you too
What did the court find that allowed you to get the sherrif in?

OP what reason does your tenant/lawyer have for not paying rent, I'm assuming the guy is a druggie or similar?

We think he is just greedy and likes to prioritize his living standards. As it is his obligation to pay rent he does not see it fit to do... When the electricity moves into arrears he eminently pays but gives a finger to the rent services... I've requested from him a date to vacate the property but he and the agent never want to supply a date to vacate...
