For all we know the Telkom employee may have looked a bit green on the outside by his seemingly unknowing remark, but his green is making us look at another pasture which may or may not be greener. If you know what I mean.

Anyway. By asking the CC, wouldn't do any damage. It is only a query at this stage.

At any rate, what Telkom are doing is known by the legal fraternity as "forum shopping" - i.e. they are trying to move things into the forum where they expect to be the most successful, or they try to move things from one forum to another in order to create delays.

Admittedly [last year] I didn't really understand this whole jurisdiction issue between CC & !CASA, but it's all too obvious to me now - that once the ECA is in effect [and perhaps amended at some point in the future - to close such loopholes] !CASA should refer competition related complaints to the CC - or it should lodge a complaint with the CC on behalf of the complainant, and then work together with the CC to reach some sort of resolution...
It would also be nice if the whole !CASA process could be streamlined to ensure fast resolutions //me day-dreaming again...![]()
