Malema's rifle trial moved to next year as prosecutor recovers from Covid-19

The firearm discharge trial of EFF leader Julius Malema scheduled to start in the East London Regional Court on Monday was postponed to next year as the prosecutor recovers from Covid-19.

Magistrate Twannett Olivier postponed the trial to 28 February.

No sooner dates suiting both the defence and the State could be found.

Malema faces charges of the unlawful possession of a firearm, unlawful possession of ammunition, and three counts of contravening the Firearms Control Act

Malema’s firearm discharge trial to start in East London Magistrate’s Court on Tuesday

EFF leader Julius Malema’s firearm discharge trial is expected to start in the East London Magistrate’s Court on Tuesday after the trial was postponed on Monday to afford the new prosecutor time to prepare.

The court heard that prosecutor, advocate Elna Smit, who handled the case since 2018, resigned suddenly.

State advocate Joel Cesar, who has taken over, asked for postponement, saying he needed time to go through the statements and consult with witnesses.

Malema’s lawyer, advocate Laurence Hodes opposed the application for postponement, saying the court was dealing with the incident that took place in July 2018.

It will delayed for many more times, and its fscking annoying... its about as open and shut a case as you can get, and its still taken 3 years to get nowhere.

It doesn't really surprise me anymore, its just fscking annoying.

In a normal functioning legal system, this case would have taken maximum 6 months... but in our world, we haven't even progressed beyond gate 1 in 3 years.

Malema sits on the JSC, which means that if any state prosecutor wants to become a judge they would have to get his approval.

I don't really buy the first reason for postponement tbh. Covid 19 isn't an excuse anymore.

That could be quite a career limiting move for Elna.
