Just playing devil's advocate here, but if the only piece of evidence the state has is this video then I think it's going to be an uphill battle get a conviction.
 
Julius Malema and co-accused Snyman plead not guilty to charges of discharging a firearm

EFF leader Julius Malema and his co-accused Adriaan Snyman have pleaded not guilty to all charges relating to an incident in July 2018 when a firearm was discharged at the EFF's birthday celebrations.

The incident happened at Mdantsane's Sisa Dukashe Stadium in East London.


Malema faces charges of unlawful possession of a firearm, unlawful possession of ammunition, and three counts of contravening the Firearms Control Act.

Snyman faces one count of contravening the Firearms Control Act and failure to take reasonable precautions to avoid danger to a person's property.

The charges stem from a video showing Malema allegedly firing what appeared to be an automatic assault rifle during the EFF's fifth birthday celebrations.

On Tuesday, Malema and Snyman told Magistrate Twannet Olivier they were not guilty of the charges.

The State called its first witness, retired visible policing unit commander Colonel Ngamlana Nkwali.

Nkwali told the court he opened a docket after the station commander Brigadier Clive Nkopo showed him the video on 2 August 2018.

But yes if he fires her they have to start all over again with the new legal team to get up to date with the case, it just buys him a bit more time to hopefully get scrapped from the table

If that News24 article is true, then it's even more important to have a law in place related to falsely accusing someone of being a 'racist'. I wonder if the true reason for the departure of the prosecutor isn't related to some form of intimidation...
 
Malema and co will continue pushing the boundaries, that is what they do. He also becoming more intimating to the justice system, if you have prosecutors resigning and judges explaining then you have trouble.

Only thing stopping the likes of him is when ordinary people stand up (like in Brackenfell) and stand their ground.

'It was not a real gun' - Malema's lawyers attempt to punch holes in State's case

The alleged rifle EFF leader Julius Malema seemingly fired in front of a cheering crowd in Mdantsane four years ago was not a real gun, and an empty bullet shell picked up after the event and handed to the police, could have been placed there months before the event in question.

This was claimed by Malema's lawyer, advocate Laurence Hodes, in the East London Regional Court on Wednesday, attempting to punch holes in the evidence presented by the State.

Hodes put it to police forensic expert Warrant Officer Philip Berger that the cartridge which formed part of the evidence against his client may have been placed there long before the 28 July 2018 EFF fifth birthday bash at Sisa Dukashe stadium.

Hodes said: "It could have been dropped there six months before without being noticed, it's possible, [it] could have been dropped there a week before. Anything is possible in these circumstances, do you agree with me?"

"Yes, your worship," Berger responded.

Under Hodes' intense cross-examination, Berger also admitted the empty cartridge had a fingerprint on it and that the forensic experts could not ascertain who it belonged to.
