It is standard procedure unless there is calculable risk involved. However, pending on the reason for absence will determine the next court date, or whether it is a matter of urgency.

I don’t know what Malema’s legal counsel stated to the prosecution for absence, but without any, this would have been ruled in a matter of urgency. That could be 7 days to appear in court otherwise you risk arrestation.

The media is lacking on the details, they just go with the “warrant of arrest” for sensational headlines.

So, anyone knows when is Malema’s court date?

Malema's legal team on Monday said his absence in court was as a result of an agreement that was reached with the state, the defence and the court magistrate when Malema made his first appearance in court in November, where it was agreed that he will only appear when his trial starts.

According to his Gauteng-based attorney Wikus Steyl of Ian Levitt Attorneys, this was to avoid the expenses incurred by the state in organising police security for Malema's appearance, and to avoid disruption in court due to the high number of Malema's supporters that attend.

“It's not like Mr Malema failed to appear in court on Monday, but his absence was as a result of a pre-arrangement between the concerned parties,” said Steyl.

So, it is an agreement between Malema's legal counsel and the prosecution.

That is the prosecution's actual reasoning as prearranged with Malema's legal counsel, but what will change from between now and May?

Malema unfazed by arrest warrant as NPA confirms issued as 'matter of procedure'

The NPA and a lawyer representing Julius Malema say the arrest warrant issued in the EFF leader's gun case is only a matter of procedure.

Eastern Cape NPA spokesperson Luxolo Tyali confirmed that warrants of arrest had been issued for Malema and Snyman as "a matter of procedure".

He said it had been stayed until their next appearance in the East London Magistrate's Court on May 8.

This was a provisional date and the matter had not been set down for trial on this date.

Tyali said on Monday the State was due to provide the docket to the defence.

Malema's lawyer, Ian Levitt, said while he understood the warrant would not be executed, he questioned why it was issued.

Levitt said it was "disgraceful behaviour" if the prosecutor was responsible for making "anything more of his attendance than what it is".

He said the defence had an agreement with the State that Malema would not have to be in court for every hearing before the trial process began.

Levitt said the legal team would not allow the State to make much of Malema not being present in court on Monday.

Malema, Zuma and co. legal counsels are making a mockery of our justice system. Yes, they are protecting their client, but it is done within their own best interests, and they are making a show of it. Reading from what Levitt told the public (or media) it seems to be a half-truth going by the previous post I made on the agreement.

Calling this "disgraceful behaviour" is a disgrace within itself.
 
Malema firearm discharge case postponed to January

Malema was also in court earlier this week for a separate case.

EFF leader Julius Malema and co-accused Adriaan Snyman must appear again in January next year in the East London Magistrate’s Court on charges of discharging a firearm in public.
Malema is facing five charges, including the unlawful possession of a firearm and ammunition, discharging a firearm in a built-up area or public space and reckless endangerment to person or property, while Snyman faces two charges.
In 2018, Malema was captured on camera allegedly discharging what appeared to be an automatic assault rifle at the Sisa Dukashe Stadium in Mdantsane, East London, at the EFF’s fifth anniversary celebrations.
According to National Prosecuting Authority spokesperson Anelisa Ngcakani, the case was postponed to 15 January 2021 for pre-trial hearing.

The trial date has been set in the court case of EFF leader Julius Malema and his co-accused Adriaan Snyman.

Malema faces charges of unlawful possession of a firearm, unlawful possession of ammunition and three counts of contravening the Firearms Control Act.

Snyman faces one count of contravening the Firearms Control Act.

The charges stem from a 2018 incident in which Malema was captured on camera using what appeared to be an automatic assault rifle during the EFF's fifth birthday celebrations in Mdantsane in the Eastern Cape.

On Monday, Malema appeared before East London Regional Court Magistrate Twanette Olivier.

Malema: I didn't do it.

Judge: Do we have witnesses?

Reality: Yes a stadium full of people specifically there to support Malema.

Judge: OK do we have any impartial witnesses?

Reality: In a stadium full of EFF supporters??? You're joking right?

Judge: OK how about other evidence? A video perhaps?

Reality: Yep there is a video

Malema lawyer: It was filmed on a potato, and its unclear whether the gun was loaded with blanks or live. Proper chain of evidence was not followed, it might have been manipulated digitally and also the person that took it got a speeding ticket in 2004 and is thus unreliable.

Judge: True. Anything else?

Prosecution: FML

...case dismissed. We all know what happened but can't convict based on this steaming pile of evidence
