Maintenance if child emigrating?

Unfortunately my daughter and her mother have decided to move overseas with her new husband.She is 13yrs.
The mother doesnt have custody as yet so im due to sign that over to her otherwise she cannot leave our shores.
My question is thus...do i still need to pay child support if she goes overseas?
 
terrible situation. interesting. so if you sign over custody to your wife, do you lose the child support as well? your wife's maintenance should have ended when she got married. but your daughter will always be yours, surely.
 
the question is not whether the child is mine or not.
Im enquiring about the maintenence.

Legally no.

Depending on how the emigration is handled the new husband might be required to legally adopt her. If that's the case you are no longer required to pay maintenance. That being said, she's your daughter, pay the money into her account directly and let her do with it as she pleases. She's your daughter and you need to look after her, man...

ummm You could pay purely because you want to give your child what you can... you know not because the courts compel you to. It's strange but it could just be some selfless thing you do because you want to...
 
If my ex moved tried to move overseas with our daughter I'd move heaven and hell to prevent that.....

IMHO this is a very unselfish thing you're doing - letting the kid go in the hopes of a better life overseas. Kudos to you.

Chat to your ex about the child maintenance. It will probably make very little difference overseas given exchange rates, maybe suggest putting it into some kind of investment trust account here for the kid's 21st birthday or something?
 
Yeah, but the mom is re-marrying. Don't maintenance agreements usually stop when the mom re-marries?

child maintenance is for the expenses of the child neither dad nor mom can shake that responsibility, certainly not through divorce/marrige
 
You still pay child maintenance wherever your child is until they are 18. If you were paying spousal support that will stop the day she marries.
 
At the end of the day,my feelings aside,there is no future in this country for anyone,especially a young child.
Im agreeing to her going because its whats best for HER,not me.She will be safer there and her opportunities will be so much greater.

Make a deal with her. Put the money for your daugher in a trust for when she needs it for signing the release documents. That way you know it's invested for your daughter and not for the ex's hair do's!

Agreed but what about your visiting rights? Part of a deal must be that they allow her to visit at least once a year.
