They can, however take you to court for unpaid debt.
only problem is you did not sign for said debt.

The more I think about this, with a good attorney, he may even walk away from the fraud charges and be convicted on lesser charges related to the number plate manipulation. The fact is, did he change the number plate before riding the toll roads and then change it back to the correct one after he got off? Is there evidence or witnesses to that?

If not, what if he admitted that he manipulated the plates as he gets threatening messages from unknown people and did not want people to see his real plates? If so, they would never be able to prove that he wanted to defraud sanral, and this simply based on the fact that he drives everywhere with the fake plates.

Driving with fake plates is number plate fraud, and while the penalty is probably not as severe as normal fraud he can still be fined. While searching for applicable penalties I got to this News24 article. The picture of different number plates have a certain "theme" to the numbers used :)

Tampering with your numberplate is NOT fraud. Not a lesser type or fraud, or whatever. There are regulations specifically for tampering of numberplates under which a person will be charged.

The only time you can be charged with fraud, when tampering with your numberplate, the state must provide evidence as to who you wanted to defraud, the intention to defraud, actual or potential losses involved. You cannot simply say a person who tampered with his wanted to defraud everyone.

Fraud is not as easy as that. Driving with a tampered numberplate does not amount to fraud, unless they can prove that he specifically wanted to defraud Sanral. That is the challenge and a good attorney will get him off the fraud charges, but the lesser charges will stick.
 
I hope this guy fights this case and do not enter into a plea agreement. I am sure scumral will secure some deal where he walks free, with only a small fine, if he pleas guilty to refusal to pay etoll fees. Hope he is not this stupid!

A lot will be riding on this case, especially the lesser additional charges.

"If motorists tamper with number plates, or spray them in such a way that they are not visible, then the driver can be arrested for number plate fraud," spokesperson Chief Superintendent Wayne Minnaar said.

The State said Stoychev, as an e-toll user, was required to pay for every gantry he crossed and thus using a falsified number plate resulted in fraud.

It was said that he used these number plates to evade the liability of paying e-tolls, which prejudiced Sanral.

If you drive on a toll road with false plates you are automatically defrauding SANRAL. There is nothing to prove.

Maseko is being investigated for fraud involving an allegedly cloned car licence plate.

He is not in court for 'avoiding etolls', he is in court on charges of fraud for manipulating his number plate. The state only threw in some additional charges to see if they will stick.

Was about to say that. Clearly he's there for fraud!!!

I am actually hoping he pleads guilty to the number plate charges in return for dropping all the other charges. They just seem petty and unprovable in a court where the number plate tampering is easily provable and a misdemeanor.
 
And ofcourse, MyBB doesnt care about the crap they post... yet wants to be a tech news site...
