Johannesburg - Judge Nkola Motata will shortly be back at work, his lawyer said during sentencing procedures in his drunken driving case in the Johannesburg Magistrate's Court on Wednesday.

Tokota asked for a "wholly" suspended sentence, saying Motata had money woes which left him "in a position" where he could not afford to pay a fine.

"It's very difficult for him to pay if he gets a fine."

He said legal fees which already amounted to close to R1m was Motata's fine. "He's gone through that heavy fine, legal fees were enormous."

He chose to challenge the charges, so R1m he spent on legal counsel is not the judges problem!

So, as would apply to the rest of us, if he can't pay he must go to the tjoekie!

I hope they give him the boot

Wtf!?

His lawyer is grasping at straws but this being Africa he will probably succeed.
 
With what is going on in the judiciary at the moment, it would not surprise me if he not only went back to work but also got a promotion.

A lot of bigshots (won't name any names) have criminal backgrounds, friends, financial advisors etc and they're doing just fine.:D
 
The sad reality is that there is a prevailing view that the JSC will not make the first judge they impeach black :(.

I think it depends on the offence specifically but in the case of a judge any record should be a disqualification IMO. He should do the honourable thing and resign.

You would have thought he would do the honourable thing and not tell lies in court! :rolleyes:

It's pretty damning when you are found guilty and everybody who was there knows you were guilty and yet you still chose to fight it.
 
Do you first become a attorney then an advocate then a judge?

Or do you study to be a judge?

And if the first is true he falls under the same code as a advocate and attorney and then he should be barred?

Do you not take an oath to never do anything un ethical and does all government establishments not have a code of conduct??

6. Oath or solemn affirmation of Judicial Officers
(1) Each judge or acting judge, before the Chief Justice or another judge designated by the Chief Justice, must swear or affirm as follows:
I, A.B., swear/solemnly affirm that, as a Judge of the Constitutional Court/Supreme Court of Appeal/High Court/ E.F. Court, I will be faithful to the Republic of South Africa, will uphold and protect the Constitution and the human rights entrenched in it, and will administer justice to all persons alike without fear, favour or prejudice, in accordance with the Constitution and the law.
(In the case of an oath: So help me God.)

(2) A person appointed to the office of Chief Justice who is not already a judge at the time of that appointment must swear or affirm before the Deputy Chief Justice, or failing that judge, the next most senior available judge of the Constitutional Court.
(3) Judicial officers, and acting judicial officers, other than judges, must swear/affirm in terms of national legislation.
 
I would feel sorry , if he originaly admitted he was drunk and wanted to go into rehab BUT with his attitude and actions , disbar him and send him to jail.
