Data Share VAS
Y’ello MTNers,

MTN SA will adjust the Terms and Conditions and Terms of Use and Service regarding Data Share VAS with effect from 2 November 2023 for all new and existing CBU and EBU Customers.

Data Share is a Value-Added Service and is a non-core offering beyond Voice, SMS and Data and is neither a stand-alone Product nor a Promotion.

For both CBU and EBU:

If the Priceplan offering does not currently include the Data Share VAS, there will be no change to that offering given to the Customer regardless of whether they are a CBU or EBU Customer.

In the event that the Priceplan offering includes the Data Share VAS, the changes are as follows:

For CBU:

  1. Where a CBU Priceplan includes Data Share, the number of Beneficiaries to which a User may share data per month will be amended from 20 Beneficiaries to a maximum of 5 Beneficiaries.

  1. Customers may link or delink their Beneficiaries once per month.

For EBU:

  1. Where an EBU Priceplan includes Data Share, the number of Beneficiaries to which a User may share data per month is also amended from 20 Beneficiaries to a maximum of 5 Beneficiaries.
  2. For all EBU Priceplans where Data Share is an inclusive VAS, the default shareable portion of any Inclusive Anytime data will be limited to 50Gb i.e. the total amount of data shareable will be limited to a maximum of 50Gb per User per month, where previously no shareable limit applied.
  3. Where a bespoke offering is required for specific Customers, any Priceplans where Data Share VAS is included will have a default setting limit of 50Gb limit. A Deal Motivation will be required for any increase of this default 50Gb limit for the duration of the proposed Offering.
  4. Customers may link or delink their 5 Beneficiaries once per month.

In all cases, this 50Gb may not be resold, onsold or traded for any gain. Please consult the revised Terms and Conditions and Terms of Service and Use, which will be made available from 2 November 2023.

For example, an EBU Offering of 500Gb in total (comprising 100Gb Inclusive Anytime data and 400gb Promotional data) will allow the User to share a maximum of 50Gb of the 100Gb Inclusive Anytime data with 5 Beneficiaries only. As per current practice, the 400Gb Promotional data is ineligible for Data Share. These limits will also apply to paid-for Anytime Data bundles purchased for use on EBU Priceplans.

FAQs

Will this affect all Customers?

No, only those CBU and EBU customers with Data Share VAs are affected from 2 November 2023, as set out above.

What will happen after 2 November 2023?
All Beneficiaries will be removed (‘delinked’) from a Data Share User’s account.
Users will be required to add (‘link’) their 5 Beneficiaries again from 2 November 2023, so that all Data Share VAS Users and Beneficiaries are made aware and must accept and agree to the amended Terms and Conditions to continue using the amended Data Share VAS.

What happens to those Users who have more than 5 Beneficiaries linked before the rollover on 2 November 2023?
All linked Beneficiaries will be removed i.e. reset to zero. This reset will also remove all records of linked Beneficiaries. The onus to record any Beneficiary rests with the User. The User must allocate any 5 Beneficiaries after 2 November 2023.

What will happen to the User’s Data allocation after 2 November 2023?
There will be no change to CBU Offerings.
In an EBU Offering, the User’s Data Share capability will be limited to 50Gb per month in total, regardless of the number of Beneficiaries linked and regardless of the amount of Data available to the User.
What will happen to the Beneficiaries’ Data allocations?
These will be reset to nil on 2 November 2023.

Can a User change Beneficiaries?
Yes, you may make a change once a month per Billing cycle but will never be allowed to exceed 5 concurrent Beneficiaries.

How can a User manage the adding and removing of Beneficiaries?Users can manage the adding and removing of Beneficiaries by way of USSD by typing *136*5#send or the MTN App. The ability to manage Data Share via MyContract and www.mtn.co.za portals is no longer available.

What are the Usage limitations and conditions of the 50Gb?
In all cases, this 50Gb may not be resold, onsold or traded for any commercial gain. Please consult the revised Terms and Conditions and Terms of Service and Use, which will be made available from 2 October 2023.

What if an EBU Customer requests a Downward Migration, Cancellation or Early Termination of their Contract/s as they regard these amendments to the Data Share VAS as unsuitable for their ongoing use?
A Remedy ticket is to be logged and ticket number forwarded to the EBU Commercial team for the attention of Nozipho Cele and Mthandeni Ngcobo. The usual Downward Migration, Cancellation and Early Termination processes and charges will apply.

What if an EBU Customer requests to continue trading commercially i.e reselling Data Share to third-parties?
The Data Share VAS is ineligible for reselling, on-selling or commercial gain. Any Customer who engages in the reselling or on-selling of Data Share for commercial gain is in breach of Terms and Conditions and Terms of Service and Use and/or their specific EBU contractual agreements e.g. MSA, MOF, etc.
In addition, any EBU Customer knowingly reselling Data Share must be brought to the attention of the EBU Commercial and Revenue Assurance teams. Failure to highlight this breach will result in the relevant disciplinary process.

Shocking, I still have 2yrs to go on my contract, with 400GB sharable data monthly. I rely heavily on the data sharing within the family on multiple devices, currently utilising about 10 SIMs.

Can MTN really change these terms in the middle of a contract period? It significantly changes the offering. Would make sense if they change the rules once contracts have expired.

Tindlund & Bunta sounds like the fancy lawyer group who will be taking MTN to court to initiate a class action suit against them, on behalf of half of South Africans ...

As far as I understand only Enterprise (business) contracts are imposed a 50gb limit, consumer contracts will not have a further GB-limitation

Yes, that's how i read and understood it too, but I have a sneaky suspicion that all 5 my contracts are business contracts.
 
If that's the case. There is little to no reason to continue with large Data packages unless they are for home use.

I've been sharing my data with family, friends and a few who don't have money for luxuries like Data, more than 50gb and 5 people
 
Anyone experienced any changes yet? Mine still hasnt reset the numbers and still allowing 20 ppl + over 50gb

Very foolish of them, I have my staff on it to use in-store and have multiple contracts with them for my whole family (5+ contracts). Definitely gonna find an alternative if this is something they're gonna go through with.

Unchanged my side still, all numbers working and says I have space for another 13. hopefully my contract not affected (500gb+500gb /mo R349*36mo BF'2022, 400gb sharable)
 
What does CBU and EBU stand for?
I‘m assuming this does not apply to Mychoice contracts because I’m still sharing more than 50gb to more than 5 sims?

Edit. “CBU is the customer business unit. EBU is the enterprise Business unit”
So that means every Datashare user should be affected by this change, that will suck big time, I’ve been sorting out friends and family with free data for their phones, most being don’t use more than 1gb per month so it was barely noticeable on my 400gb contract.

But I think this change has been motivated by small time “operators“ selling data from big contracts using datashare, I’ve seen a few.

I would have hoped this change would have been communicated in some form, which MTN haven’t so hopefully they have shelved this idea or scaled it back.

Just got this yesterday
I just checked my sms and I also got this SMS.
Its really weird how contracts can seemingly be amended at any time these days, change the rules and increase the monthly charge whenever it suits the network.
 
Seems like they shifted the date to 9th November.
So let's wait and see
 
All my datashares are still in place, has anyone had any removed yet?
