MTN vs Cell C: The battle over "free"

I think the ASA needs to put the lid on all the cell providers claiming anything free on their offerings since there are none. Unless I get a SIM for no cost, pop it into my handset and make a call without having to recharge and "make a quick chargeable call", it is not free.

Or just ban all advertising by Vodacom, CellC, MTN and 8.ta - I'd bet you won't even be able to imagine such a world...

+1 nothing is for free.. You shouldn't be able to recharge to get free money! It should come free automatically. Receive free value to the same amount of airtime.

The one thing I hate about MTN ads is the fact that they spell Mahhala wrong, it's mahhala people not mahala
 
"Buy 2, get one free" must drive you guys nuts hey?
 
Webber Wentzel Attorneys, on behalf of MTN, hit back at Cell C’s ASA complaint, arguing that:

The ASA should not give any credence to Cell C’s submission that there are countless other examples of cell phone packages and contracts with free aspects, as none of these examples were attached to the complaint;
MTN has not received a complaint from either 8ta or Vodacom, whose advertisements were attached to the complaint. It therefore appears that Cell C is deliberately targeting MTN and its advertisements and that the complaint was brought in bad faith;
The word “Mahala” in the advertisement is used as a reference to MTN’s “Mahala” offerings and not in the ordinary sense [hence free].

MTN could have won if they said their word is spelt 'mahala' not 'mahhala' (the correct IsiZulu spelling, meaning free).
