My aunt was targeted by the Bureau of State Security throughout the 70's and 80's for her anti-apartheid activism. She is white. How does this 'black versus white' argument promoted by some on this forum build a non-racial society when the very basis of these thoughts are built on Apartheid racial ideology? The race-based 'us vs them' mentality only perpetuates the very tenets on which Apartheid was founded. Ngwe, you score an own-goal every time you use the 'we' vs 'them' racial ideology.

It only becomes disproportionate when significantly greater or less than 90% of the victims are black.

Provide some examples showing how the courts are colour blind by listing where a black person has been prosecuted for hate speech. We all know the white examples exist so unless you can provide something, you're talking rubbish. Remember, you made the claim that the courts are colour blind so it is up to you to provide proof.
Jon Qwelane was found guilty of hate speech in 2011.
Velaphi Khumalo has been taken to court for alleged hate speech.

Ah, how predictable. Nothing but pure BS as usual. What has this got to do with victims? We are talking about people committing acts of hate speech - ie. the perpetrators. Seeing as how you've decided to talk about disproportion, you would think that in a country with no shortage of anti-white hate speech and where blacks outnumber whites so heavily, you could provide something. But no, just more victimhood.

TBH I think the courts predominantly are colourblind...

The bigger issue is actually getting the cases brought before the courts themselves.

The HRC as an example are completely and utterly NOT colourblind...

Khumalo doesn't count if his case is pending.

What about the countless HRC complaints where no action is ever taken?

Free speech and police-state issues aside, If this law were to be applied fairly, that's one thing but I, for one, have ZERO faith in that happening based on the past year alone.

We can hope, but getting the case to court if a racist white estate agent says something as opposed to a guavamint official will have completely different outcomes given the rabid reactions we've seen. Alltogether the law is so ridiculously broad it will be open to abuse from anyone who has their feels hurt, as opposed to actually protecting legitimate hate speech.

The way that things work is that the burden of proof is on you to prove that the courts are racially biased. It is virtually impossible to me, or anyone, to prove the negative.
