More likely you live in a very small narrow little world, never travelled to Europe to witness the hatred between European nations? Or locally, the hatred of foreigners in SA's xenophobic culture? That is just to cite only two examples. Haven't even moved onto the other categories yet.
Oh, I know they exist, I just don't think they represent the majority

My opinions on the ANC, EFF, Front National, Zuma, Malema, tribalism, Steve, etc. may easily swamp me with legal trouble.
On what basis? The law doesn't offer protection from criticism based on political affiliation.
Unless your opinions are simply about their race, or gender, or sexuality, etc, you have nothing to worry about.
 
Surely Hate Speech laws should protect the victim from consequences related to the speech. It should not simply be a law prohibiting free thoughts about others? If you express a private prejudice to a certain group of people, that should be allowed. However, professing a public criticism of a certain group of people with the intention of causing harm to them is what is important.

Everybody on earth feels a certain prejudice to certain groups of people. But calling on others to act on them is what is dangerous. We can't easily change people's private thoughts and feelings. But we can stop them from inciting others to act on those thoughts.

e.g. I can't stand purple people - they eat too many apples vs We should beat up purple people because they took away all our apples.

Well that's just it. I agree with what has been said earlier in the thread in that people should be allowed to express their views and be out in the open where everyone can see them. Incitement, however, is another matter. I may not like purple people and why shouldn't I able able to express that? Calling for violence against them though is not on in my book and that is what constitutes hate speech.
 
Nah, Malema was excused. Dubul' ibhunu was declared unconstitutional to utter or sing the phrases. Umshini wami on the other hand is open season to be uttered or sung.

Malema and Shivambu was taken to the high court by Zille, where it was ruled that the two must make a public apology to Zille, retract their comments and to settle Zille's legal bills. It was a defamation case.

Floyd Shivambu was heard by the ANC’s National Disciplinary Committee and received a three-year suspension, and where did he go then, did he sit on his arse for three-years?

The concourt was hearing an appeal after the ANC sought clarification for the equality court ruling. Shivambu was fined over the journalist remark, the ANC case against him was for (or in addition) internal discipline not that same case.

Well they are politicians by occupation/trade so prison time for sure.

Am I still allowed to joke about race, sexuality gender etc? Am I still allowed a sense of humor and have a chuckle at them?

Am I still allowed to stereotype a certain group of individuals in a satirical context?

The answer doesn't really, someone somewhere is bound to be offended and will now have a legal avenue to take me to court.

I suspect that South Africa's new national sport is going to change from Soccer to "Hate Speech Court Action"

(e) colour;
(f) sexual orientation;
(g) religion;
(h) belief;
(i) culture;
(j) language;
(k) birth;
(l) disability;
(m) HIV status;
(n) nationality;
(o) gender identity;
(p) albinism; or
(q) occupation or trade.

The victim will use those two characteristics or perceived characteristics to twist a cork up my crevice. Culture alone is a deadly territory to traverse, not to mention that there is a Customary law, and believes are open to interpretation. The act, however, does create a space to protect ethnicity, nationality and language which many will praise as it may resolve current issues. Like the current acts, this must still be signed into legislation and tested in court.
 
Calling people 'clever blacks' or 'lazy' by race is legal? Zuma better be careful.

I tend to offend people who don't like my point of view, based on disagreements in opinion, not because I attack who they are.
I've never offended someone purely because of their race or anything like that.
