Actually they can and they have, the take-down notice goes to the site, at which point they remove it from the tracker, then only the users already connected int he peer can use it, no new users can join and if for any reason you loose connection you will not be able to reconnect to the peers again.
TPB was the first to receive these DMCA takedown notices and they complied.
Previous to usage of a DHT for distributing peers, trackers were the only method of finding peers. Ever heard of DHT? No need for tracker sites.
Most private trackers do not work with DHT, they specifically require that it be disabled, and then you still need a centralized location for said torrent as the hash will vary between creations.
This still leaves your IP address open to DMCA lawyers and open to prosecution.
