Ok, so now the wifey bought a 2ndd hand car, but got an empty tank. Is this a peeress quite for the car dealer to fill the tank or not. How long does the CPA law work if you decide to take the vehicle back if you changed your mind. If the dealer says that they give you a month warranty for anything that's wrong on the car. I noticed today that the indicator is not working when turning to the right, 1 spot light is not working. I have picked up that the car was making a hard noise going over bumps, but never thought that the shocks needed replacing. Can I take the car back and get the dealer to fix all the issues. Can I blackmail them by saying if they don't replace the rear shocks that i no longer want the car.

Where do I stand in this case?
 
The dealer must have given you a car that was fully road worthy, indicators not working and headlights not working would have made the car fail as far as I know... take it back and demand they fix the issues.

The empty tank is a bit of an annoyance, but not something you can hold the dealer to really unless they stated the fee included a full tank.
 
Don't take such a hard stance with comments like "blackmail". Sounds to me like you've changed your mind and want an easy out, in which case the CPA protects the dealer as well.

Take the vehicle back and raise your concerns in a decent fashion and I'm sure they'll happily sort them out.

The CPA protects you from potential "known" defects for six months.
 
Did the dealer have the car put in your name?
Then it was roadworthy at the time.

The blown globes - seems to me they went after you got the car. How will you or they know how kong the globes will last. Diffirent if you picked up the car and then that night discovered the blown globe.

Shocks - I'm sure are tested for COA.
How long after you got the car did they start showing problems? This is also a general wear and tear item...
 
I do not think you have any case with the CPA and blackmail will not get you anywhere but into more trouble. Here is a novel idea... Why not have a civilised conversation with them about your concerns and see if they will do anything from their side?
 
I just spoke to the sales guy and he said that he will speak to his boss about the first 2 issues, but he told me that the car went for roadworthy and it did pass with them and said that they did not find any problem with it. My concern is that if you drive and hit a bump in the road then you can feel like a hard knock. it is driveable, but its going to wear the tyres out very quickly and the tyres will have to be replaced all the time. Tyres are not cheap anymore. I also hear that the car does not have shocks at the rear, but only springs.

I just want to know if the dealer must replace it since its not condusive to drive like that for a long time. since we only picked up the car yesterday, we have a right to tell them about replacing the springs while we can still take the car back and tell them that she is not interested in the car anymore, meaning they got no leg to stand on.
 
Could simply be cheap and nasty suspension and replacing it might not even solve the problem.

What car is this?

There is no option for "not being interested". The dealer has the choice to either repair or refund you or offer another alternative.

I will suggest you take your car for roadworthy test and armed with all the issues, you will them be able to show the dealer. If they cant sort it then return the car. But you will have to do this asap.

ANyway , replacing a bulb is less than R20.

you want me to pay for roadworthy when the car should have gone for a proper roadworthy and 120 point check. why don't i do a suspension check at the roadworty, i think it costs like R50 if i'm not mistaken.

If they do find any issues with the rear springs then the dealer is obliged to fix it or take the vehicle back.
 
Its a Tata Indica

Exactly what I wanted to ask in the first place, is it a Tata.

The rear suspension on those cars I shockingly hard (aka non existent) even on brand new ones. Just popping into a driveway is enough to knock your teeth out.

Did you not test drive the car at all before purchasing?
 
You bought a Tata Indica and are surprised that it doesn't give you a great comfortable ride?
 
Ok now, just an update on fixing the car.

I took the car to a roadworthy centre and found out that the rear rubbers were totally worn. if you shake the car up and down then you can actually see the rubbers, which is located. When you open your boot then you will see the 2 humps on the sides where they normally replace the shocks. there is normally a rubber cap placed on it to close it. when i took it off just to check, i noticed the whole piece lifting up and down. there was silicon attached around the area, but it was so worn that is was hopping up and down.

I showed this to the dealer and he agreed to replace the rubbers. I actually told him why he does not replace the rear shocks with brand new ones as the price difference is not that much. he now just wants to replace only the rubbers. i told him if i am not happy when they do it i will take the car back.

This was 6 weeks ago when i heard last of these guys. According to him. they were going to order the rubbers and let me know when they come. surely getting shock rubbers for Tata Indica is not hard to find. they should be able to find them locally, even if ordering from overseas will not take 6-7 weeks to arrive.

Just want some advice where is stand with what my options are:

1) Do i just take the car back and tell them i don't wanted anymore, since they promised the rubbers within the 10 day cooling off period.

2) just drop the car off and ask for a replacement car

3) complain to the CPA and see where i stand with this and what my rights are.

My wife is driving the car currently.

I find it really pathetic how these people can treat you as nothing.

Just feel like telling them that i will go to the papers or hellkom and complain about their branch how bad their service is.

Those are shock mountings that you are talking about, they shouldn't be too expensive. Just go buy some yourself, take it to the dealership and insist on a refund for the money you spent, after you have them fit it for free. And seeing as the price difference with shocks isn't that much, which is weird, just have them change that while they are at it.

i would never do it myself as its not my responsibilty. they got paid in cash for the vehicle and promised to replace the rubber shock mountings. i am gonna frighten them in saying that i am not gonna speak to them anymore and that my lawyer will be in contact with them soon if its not fixed by end of this week.

Your wife driving around in a potentially unsafe car is your responsibility. Just rock up with the parts, they said they'll replace them, and demand a refund for the money spent.

its not unsafe, its just that when going over bumps or holes you hear loud noises.

It will cost you less to buy the shock mountings and ask the to refund and fit them for you. Lawyers will cost you a lot. Dont be stubborn. Just follow what the masses are saying.

It is your responsibility to fix the car as your SO is driving it daily.
