Options for Cell C Contract Cancellation

Not sure if anyone can advise i have a cell c contract, 7 months old on the iphone 5, ported from vodacom to get this contract and given all the problems on their network i really cant take it anymore

  • i miss nearly 80% or my calls, most of them going directly to voicemail
  • i drop nearly 80% of my calls, and finally give up trying to contact anyone
  • don't have any data connection that provides speeds that's usable


given all of this, being on cell c is costing me more than its worth

so would like to cancel with either the following option

  1. Cancel with buying the phone , not sure if penalties will apply , so that i can port back on prepaid
  2. or just return everything back incl phone, not sure if this is possible


please can anyone advise if they where successful
 
I think you are allowed option 1 under the CPA, where you are supposed to pay off the remainder of the phone and some sort of penalty which I think can be a max of 3 month subscription. I'm not sure, best is to PM the Cell_C rep and ask him what do to.

Please post it here as well, as it would be helpful to a lot of other people who want to get out of this mess.
 
I managed to get option 2 with Vodacom in 2009 when they were having serious BlackBerry issues.
After enough complaining to the Vodacom rep on here they just picked up my phone one day and I stopped paying.

I've been trying for months now to do this with Virgin Mobile because the Cell-C network is a joke. i think I am going to end up paying for the phone. It will be worth it though.
 
Also cancelling.

I moved from Vodacom to Cell C due to continuously being butt banged by OOB shark. End May 2014 Cell C now ALSO charge OOB rates. To make matters worse:
1. You can't set a ceiling on Data. You can set an account limit.
2. Once you reach the account limit you can't use ANY voice or SMS bundles. Effectively you can receive SMS and phone calls only.

The changes to data rates is massive. T&Cs rewritten mid contract.

In my opinion not being able to use bundle that you've already paid for is breach/denial of service from Cell C's side. I'm seeking legal opinion. Happy to settle the outstanding device cost. Not paying a cancellation penalty. Not paying early cancellation.
 
Yes exactly. A contract surely CANNOT stand if you change the price! Otherwise I'll start writing contracts for 'R0 service fee' then next month I'll change it to R1000/month service fee.

I believe they "reserve the right to change terms on a contract" but that doesn't mean you have to accept them surely?! Plain language or not, CPA or not, this is simple contract law. Wish someone with a strong case would take it further and get a judgement against these sharks!
 
CANCELLATION OF CELL C CONTRACT

i HAVE HAD IT WITH CELL C AND ABSOLUTELY AGREE 100% WITH THE MESSAGE RE 80% MISSED CALLS ETC. I JUST WANT OUT!!!!

I am in the same boat.
Moved from an eternity at Vodacom to CellC in Feb 2013 and got the S4. Hardly ever used the calling features of my phone and the 1GB data bundle attracted me. Here in Edenvale I don't have an issue with data on CellC so all was good.
Feb this year I moved from contracting for my one client into a management position. In this position I receive frequent calls and have to contact staff. And bang. Now I experience CellC in all their glory.
I often get messages from colleagues telling me to switch on my phone as they can't get hold of me. I never switch off my phone! Also very common calls are dropped mid sentence.
Sick of CellC now.

Took a new top up contract on Thu with Vodacom (move back and G3 deal). Now planning on fighting with CellC to terminate my contract with no penalty. Happy to pay the remainder of the phone as that is fair, but no penalty. Their network sucks and it is only fair they release me from the contract.

But... If they insist on a penalty - I will pay. I want out that badly. I need to get converted to prepaid so I can port my number back to Vodacom.

Thus thread is going to be interesting it seems.

LEt me give you a very handy tip. Pm Cellc rep here or PM Cellc on Facebook. Let them do a number change for you. Go buy a prepaid cellc staterpack rica it and activate it. When you phone you they will move your number that is on contract to the prepaid sim which you can then port to any network.

You will still have your cellc contract but just with a new number. The number change usually costs R250 but I did it many times via the rep and facebook and they don't charge you for it.

Send them a PM, got a call form Cell C, told them what I want to do, and was told to get a Cell C Starter pack and Rica, then call(or PM) and do the sop
